    PREFACE: WHY I WRITE

    At the time of writing this preface, my home state of California is being ravaged by wildfires – from Pacific Palisades to Pasadena, the headlines are ominous. Several people have died, thousands of homes and businesses are in ruins, and estimates of the damage now exceed $100 billion.

    A tragedy of this scale affects countless families in the most visible and painful of ways. I’ll leave it to experts to determine the extent to which natural disasters like this are preventable. A collective tragedy caused by an act of nature may not have a direct culprit – but the individual tragedy of the inheritance heist usually does. And for a family whose inheritance is stolen, the devastation – both material and emotional - is comparable. The childhood home gone, assets vaporized, an entire legacy and hope for the future destroyed.

    I’m writing to help you, the reader, avoid inheritance disaster. There are red flags – distinct warning signals of estate or trust wrongdoing – that you can detect and follow up with preventive measures. You can stop the financial exploitation of an elderly loved one if you spot it early enough, and you can safeguard an estate as its rightful heir.

    Other readers may be victims of an inheritance heist – a wrongdoer, whether it’s another family member or an interloper, has managed to hijack their family’s estate or trust. I write for you as well. The sting of loss of a loved one is compounded by the injustice of a stolen legacy.     I tell my clients who have been wrongfully disinherited or excluded from a trust a simple truth: We’re starting at zero. The methods may vary, but the result is always the same: a betrayal of the deceased's wishes and a profound injustice to the intended beneficiaries. This betrayal undermines not only legal standards but also the essential values that support human well-being and the collective good.

    One particularly troubling form of inheritance heist involves trust distribution disasters. These occur when carefully laid plans for asset distribution through trusts go awry, often due to unclear language, unequal distributions, timing issues, or trustee mismanagement. Such disasters can lead to protracted legal battles, eroded estate values, and irreparably damaged family relationships.

    The perpetrators of these heists are not always strangers. In fact, they are often family members, trusted advisors, or caregivers who exploit their position of trust.     Since litigating my first inheritance heist case shortly after becoming an attorney in 1976, I've seen these scenarios play out time and time again. Elders' retirement nest eggs can be swept away in an electronic heartbeat.

    Increased longevity: As people live longer, there's a higher risk of cognitive decline, making them more susceptible to manipulation and undue influence.

    Increased reliance on caregivers: As the population ages and more seniors require daily assistance, the number of caregiving relationships has increased. While most caregivers are dedicated and ethical, this trend has unfortunately also created more opportunities for exploitation.

    Changing family dynamics: With the clash of more complex family structures and an increased reliance on caregivers, the potential for conflicts and exploitation in inheritance matters has grown significantly.

    Stepparent dynamics: With the increase in blended families, conflicts between stepparents and biological children over inheritance have become more prevalent. These situations often involve complex emotional dynamics and can be particularly prone to inheritance disputes.

    THE IMPACT OF INHERITANCE HEISTS

    The consequences of these heists extend far beyond the financial realm. They represent a violation of both legal and moral principles that can:
