Dear Dr Alexander,
Thank you for your letter of 6th September 2015, which was further to your letter to the NHS
Trust Development Authority of 22nd August and my reply dated 27th August. I apologise for
the delay in responding.
As I stated in my letter of 27th August, whilst Dr Beatts case is going through the
Employment Tribunal appeal process I am unable to take action in relation to Dr Beatt
specifically or his employment issues. I understand that the Trusts appeal has been heard
and a judgement is pending. The NHS TDA will examine the judgement closely when it is
available and determine whether any action is required to specific findings. If we consider
that specific actions are required, we will hold the Trust Board to account to ensure that they
are taken.
The NHS TDA takes matters of patient safety extremely seriously. You have clarified in your
letter that you have concerns regarding the investigation by the Trust of patient safety
concerns raised by Dr Beatt, and specifically that you believe that concerns were
suppressed by senior managers resulting in harm to patients. I have personally written to the
Chair of Croydon Health Services NHS Trust, Michael Bell, to ask him to set out the patient
safety concerns raised by Dr Beatt, the actions taken by the Trust Board to investigate those
concerns, the findings of the investigation and and any actions that have been necessary as
a result. The NHS TDA will seek assurance that the Trust Board has taken appropriate
action. I will write to you once I have received a response from Mr Bell.
Finally, you requested clarification of the role of the NHS TDA in relation to the Fit and
Proper Person Test. The role of the NHS TDA is to ensure that NHS Trusts undertake Fit
and Proper Person tests where relevant. Responsibility for these tests lies with the
employing organisation, in this case the board of Croydon Health Services NHS Trust.
I hope that I have answered the points in your letter. As indicated above, I will write to you
again once I have received a response from the Trust Chair.
