Dear Sir:
This is in response to your Letter dated September 21, 2014 wherein you, on behalf
of your client, Martin, Alan and Francis, all Desiertos, demanded that our client
vacate and surrender possession of the properties currently held by our client, plus
undetermined liquidated damages and reasonable compensation for the use of the
property.
While we are in agreement that your clients are the registered owners of the subject
property, we do not subscribe to the conclusion that your clients are the real owners
of the same. But merely holders of the property as trustees of Rodrigo Desierto who
gave us . In this regard, our client obtained the right to use and possess the subject
property from the lawful owner. Hence, the possession of the subject property by
our client has been lawful from the beginning.
Furthermore, would like to inform you that our client have bought the subject
property from your clients. Hence, your clients have no right to evict our client from
the subject property.
In view of the foregoing, we demand that your client cease and desist from further
invoking their unlawful right against my client. Otherwise, we shall be constrained
to advice our client to take the necessary legal action to protect his rights.
