1.WhataretheleaveentitlementofGovt.servantsservinginavacationDepartmentw.e.f.1.9.2008?
EarnedleaveforpersonsservinginVacationDepartments:

(1)(a)AGovernmentservant(otherthanamilitaryofficer)servinginaVacationDepartmentshallnotbeentitledtoanyearnedleav
performedinanyyearinwhichheavailshimselfofthefullvacation.

(b)InrespectofanyyearinwhichaGovernmentservantavailshimselfofaportionofthevacation,heshallbeentitledtoearnedleav
of30days,asthenumberofdaysofvacationnottakenbearstothefullvacation:

ProvidedthatnosuchleaveshallbeadmissibletoaGovernmentservantnotinpermanentemployorquasipermanentemployinrespe
hisservice.

(c)If,inanyyear,theGovernmentservantdoesnotavailhimselfofanyvacation,earnedleaveshallbeadmissibletohiminrespectof
26.

Forthepurposeofthisrule,thetermyearshallbeconstruednotasmeaningacalendar yearinwhichdutyisperformedbutasmean
actualdutyinaVacationDepartment.

AGovernmentservantentitledtovacationshallbeconsideredtohaveavailedhimselfofavacationoraportionofavacationunlessheh
generalorspecialorderofahigherauthoritytoforgosuchvacationorportionofavacation:

Providedthatifhehasbeenpreventedbysuchorderfromenjoyingmorethanfifteendaysofthevacation,heshallbeconsideredtoha
noportionofthevacation.

WhenaGovernmentservantservinginaVacationDepartmentproceedsonleavebeforecompletingafullyearofduty,theearnedleav

shallbecalculatednotwithreferencetothevacationswhichfallduringtheperiodofactualdutyrenderedbeforeproceedingonleave
tothevacationthatfallsduringtheyearcommencingfromthedateonwhichhecompletedthepreviousyearofduty.
AsperRule29(1)thehalfpayleaveaccountofeveryGovernmentservant(otherthanamilitaryofficershallbecreditedwithhalfpay
twoinstallmentsoftendayseachonthefirstdayofJanuaryandJulyofeverycalendaryear.
2.WhetherencashmentofleaveisallowedafterLTCisavailed.

Sanctionofleaveencashmentshould,asarule,beloneinadvance,atthetimeofsanctioning

expost facto sanction of leave encashment on LTC may be considered by the sanctionin
exceptionindeserving
caseswithinthetimelimitprescribedforsubmissionofclaimsforLTC.

3.WhetherencashmentofLeavewithLTCcanbeavailedatthetimewhenthe
theGovernmentservantonlyorcanleavebeencashedatthetimewhenLTCis
members?

AGovt.servantcanbepermittedtoencashearnedleaveupto10dayseitheratthetimeofavailingLTChimselforwhenhisfamilyava
conditionsaresatisfied.
4.Whetherleaveencashmentshouldberevisedonretrospectiverevisionofpay/D.A?

Intermsof38AofCCS(Leave)Rules,encashmentofELalongwithLTCistobecalculatedonpayadmissibleonthedateofavailing

onthatdate.IfpayorDAadmissiblehasbeenrevisedwithretrospectiveeffect,theGovt.servantwouldbeentitledtoencashmentof
rates.

5. Whether encashment of Earned Leave allowed to a Govt. servant prior to

Central Govt. is to be taken into account while retiring ceiling of leave enc
superannuationandretirementfromCentralGovt.?

Encashment of EL allowed by the State Governments, Public Sector Undertakings, Auto

servicesrenderedintheconcernedGovt.etc.neednotbetakenintoaccounlforcalculatingthe
ofEarnedleavetobeencashedasperCCS(Leave)Rule.

6.WhetherleaveencashmentcanbesanctionedtoaGovt.servantonhissupe
undersuspension?

Leaveencashmentcanbesanctioned,howeverRule39(3)ofCCS(Leave)Rules,1972allowswithholdingofleaveencashmentintheca

whoretiresfromserviceonattainingtheageofsuperannuationwhileundersuspensionorwhiledisciplinaryorcriminalproceedings

him,ifinviewoftheauthoritythereisapossibilityofsomemoneybecomingrecoverablefromhimonconclusionoftheproceedi
conclusionoftheproceedingshe/shewillbecomeeligibletotheamountsowithheldafteradjustmentofGovernmentdues,ifany.

Yes,Asperrule50(5)(iii)aGovt.servantshastosubmitabondtoservetheGovt.foraperiodof3years.AstheGovt.servantwouldstillb
Departmenthemaybeallowedtosubmithistechnicalresignationtotakeupanotherpost
withintheCentralGovt.
10.WhetherwomenemployeesofPublicsectorundertakings/Bodiesetc.AreentitledtoCCL?

OrdersissuedbyDOPTarenotautomaticallyapplicabletotheemployeesofCentralPublicSectorUndertakings/AutonomousBodies,Ra

isforthePSUs/AutonomousBodiestodecidetheapplicabilityoftherules/instructionsissuedforthecentralGovernmentemployeesto
consultationwiththeirAdministrativeMinistries.
11.WhetherGovt.servantcanbepermittedtoleavestation/goabroadwhileonCCL?

Childcareleaveisgrantedtoawomanemployeetotakecareoftheneedsoftheminorchildren.IfthechildisstudyingabroadortheGo
abroadfortakingcareofthechild,shemaydososubjecttootherconditionslaiddownforthispurpose.
12.WhatistheintentionbehindtheinstructionthatCCListobetreatedlikeELandsanctionedassuch?

TheintentionisthatCCLshouldbeavailedwithpriorapprovalofleavesanctioningauthorityandthatthecombinationofCCLwith

shouldbeaspertherestrictionofcombinationwithEL.Therestrictionofthelimitof180daysatastretchasapplicableinthecaseofE
caseofCCL.TheotherconditionslikeCCLmaynotbegrantedforlessthan15daysorinmorethan3spells,etc.,inayear,willapply.
