Failure of Destitute Relief System & Need for Social Security


Beggary continues on large scale even after 35 years of the Karnatak Prohibition of
Beggary (KPB) Act, 1975 coming into force, and several laws on beggary being in force since
pre-independence era. Rashtrotthan Sankalp Trust (RASTR) has carried out a Public Audit of
the Beggary Relief System. Report is available at www.rastr.in. Associates of RASTR
presented the audit report to the government on 25-Sep-2010.
The Audit concluded that, among other things, the government has failed to:














Appoint all 15-30 members on the board of the Central Relief Committee (CRC)
Appoint non-official members on the board of the CRC
Appoint Board of Visitors to the Nirashritara Parihara Kendras (NPKs)
Ensure transparency and public participation in the functioning of various agencies for
destitute / beggary relief
Ensure that the Beggary Cess is collected by the Local Bodies
Secure the collected Beggary Cess for destitute relief
Publicise the Act and create awareness among the citizens
Create helplines for reporting instances of beggary or cases of people in need
Devise proper system of identification and tagging beggars and documentation
Provide adequate infrastructure required for effective Destitute / Beggary relief
Build necessary social & relief infrastructure in making the prohibition effective
Facilitate study and analysis of beggary, destitution and social security
Make amendments necessary to make the KPB Act effective

The local bodies are either not collecting the beggary cess properly or depositing the collected
cess to the Central Relief Fund (CRF) as required by law. As a result of these lapses:


Beggary relief has suffered

Citizens are shortchanged / cheated

The Audit finds a systemic failure of the Beggary Relief mechanism. From the facts
emerging from this audit, it is evident that successive governments and the Central Relief
Committee (CRC), as constituted from time to time, have failed pathetically in performing
their duties towards beggary relief both in letter and spirit as envisaged under the KPB Act.

The Principal Secretary to the Government (Social Welfare) accepted the findings of the
audit. He questioned as the Act and system had failed, whether the Act and agencies
should be scrapped? Later he said that the government would look into the matter.
The study found that the major issues with beggary / destitute relief are:


non-awareness about this whole issue

societys failure in taking cognizance of the entire matter

absence of systematic humanitarian solutions, and

failure of government in enforcing the laws efficiently and in the right spirit

Beggary can be practically eliminated if there is will and determination to do so. The
Government must stop the farce, which it is continuing in the name of beggary relief for
over 35 years, and act to bring about real change on ground. The important steps in this
endeavour should be implementation of the KPB Act in its true spirit, creating awareness
among the public, building the necessary infrastructure, and by appreciating the links
between poverty, unemployment, disabilities, destitution and beggary, and devising
suitable solutions viz. a comprehensive Social Security Net.
RASTR made the following important recommendations for a successful Destitute Relief
System and Social Security Net:


Introduce and Foster Efficiency, Transparency & Accountability

Plug Holes in the Cash Box & Ensure Financial Prudence

Promote Analysis and Research on Social Security / Destitute Relief

Build Adequate Infrastructure and Ensure Rehabilitation not Charitable Relief.

Distinguish Destitution from Professional Beggary, and respond separately

Raise / Widen the Social Security Net and enact and implement a comprehensive
Social Security Act.

Eliminate Escape Avenues for professional beggars

Introduce Out of the Box Solutions like community service / civic facilities upkeep
for able-bodied beggars

Use Technological Aids in management of Destitution Relief (such as biometric


identification and tagging of beggars; computerisation of destitution relief records)

Educate Citizens about the law and the destitute relief system / social security net

Introduce single point Helpline through out state to report instances of beggary or cases
of people in need

Appoint a Committee to study the entire gamut of Destitution, Beggary, beggary relief and
its administration since the enactment of KPB Act, 1975 and lay down guidelines for efficient
handling of destitution relief and to devise a comprehensive social security net.
