INTELLECTUAL PROPERTY ON THE INTERNET: ISSUES & CHALLENGES

This dissertation is to analyse the impact of internet on the different types of intellectual property and the issues and challenges arising out of the digitalisation of IP and the enforcement of IP rights in the cyberspace. In this topic, firstly I would be dealing with the emergence of intellectual property on the internet and how IP migrated to the digital arena. And next chapter is about the issues regarding copyright in the internet which includes broadcasting piracy, P2P Sharing, electronic rights management, ISP liability, and content distribution and also about the international agreements which speaks on the copyright in the internet and next about how to face the challenges and the ways to minimize these problems. The next chapter would be about the role of trademarks in the internet and how the trademark laws are applied in the digital space. The issues which are discussed in this chapter are principle of territoriality in the trademark laws, cyber squatting, hyperlinking, Meta tagging, deceptive trademark infringement and misuse of well known trademarks and finally about the Domain name system. The next chapter would be about the impact of internet in the patents field. The effect of electronic form of prior art and its validity is discussed in this chapter.
