Specificactivitiesarelistedinthe6MonthServiceChecklistformandshouldalsoincludethe following: Determineiftankpumpingisneededbymeasuringthesludgeinthepretreatmentand treatmentcompartment. Inspectthetankandothercomponentsforwatertightseals. Inspectanyfloats/switches,controls,pumpsandelectricalcomponentsinthesystem forcorrectoperationandfunctionality. Inspectandcleanthefilters(ifapplicable). Inspectandflushthesystempiping(ifapplicable). Inspectthepumpsandvalvesforproperoperation,pressure,and/orflow(ifapplicable). Inspectanyadditionalsystemcomponentswhichhavebeenadded. Recordpumpcycles,flow,andallotherrelevantinformationorsystemproblems.(if applicable). Completethereportandsummarizetheserviceperformed,noteanyconditionswhich mayrequireadditionalattention,documentanycorrectionsmadeandany recommendationsyoumayseefit.Providetheowneracopyofallthepaperwork. Thesummarizedreportmustincludeanyrepairsthatmustbemadeoutsideofthe currentvisitandanestimateofthecostoftherepairsandthetimeofcompletion. Thisagreementshalllastforthetermof__________________________ Thefeefortheserviceprovidedunderthisagreementshallbe$_____________ Paymentshallbemadeuponthesigningofthisagreement. TermsandConditions
1.) (ThesemaybealteredbylocalJetInc.Distributors) ProvisionsofServicesTheownerandserviceproviderhaveagreedthattheservices areprovidedonanasneededbasistofulfilltheownersresponsibilitytooperateand maintainthesysteminaccordancewiththeOregonDEQregulations.Theparties acknowledgethatregulationscanchangeandtheremaybeanincreaseinthelevelof servicewhichwasinitiallyagreedupon. OwnersObligationforSystemMaintenanceTheownermustpromptlynotifythe serviceproviderofanyknowndefects,problems,orcomplaints. UnscheduledVisitsUponnoticebytheownerorOregonDEQ,theserviceprovider shallberequiredtoperformemergencyservices,whichmayincluderepairsand replacements.Thesewillcorrectconditionswhichcanposeorarelikelytoposearisk totheATT,publichealth,publicsafety,ortheenvironment.Theownerwillbe responsibleforpayingtheserviceproviderforadditionalservicesandproducts. AccessTheownerwillgranttheserviceprovideraccesstotheATTforservice includedintheagreement. NaturalandManMadeEventsExcludedTheserviceproviderwillhavenoliabilityor obligationsinconnectionwithanydamageresultingfromelectricaloutage,storms, flooding,lightening,earthquakes,oranyactofGod.Theownerwillthenbe responsibleforallcostsincurredinconnectionwithsuchevents. DelaysTheserviceprovidershallnotbeliablefordelaysinperformanceornon performancecausedbycircumstancesbeyondcontrol.Sucheventsincludebutare notlimitedtostorms,flooding,fires,governmentactions,laborstrikes,labor shortage,ortheinabilitytoobtainmaterials,equipmentortransportation.

FeesTheservicefeesarelistedbelow.Theserviceprovidermustprovideatleast30 daysnoticeofratechanges. ServiceProviderLiabilityTheserviceprovidersliabilityunderthisagreementforany defectorfailureislimitedtoanexchangeoftheproductand/orareturnofthe amountspaidforservice/materials.Noclaimshallexceedthetotalpaidforthe service/materialsforwhichdamagesareclaimed.Theserviceproviderisnotliablefor lostprofitsorincidentaldamages. 11.) NonwaiverNoactionorinactiononthepartoftheserviceprovidershallbedeemed awaiverofrights,remedies,breaches,orsubsequentdefaultsbytheownerinthe performanceoforcompliancewiththetermsofthisagreement. 12.) TransferabilityThisagreementcannotbetransferred,delegated,orotherwise assignedtoanypartywithoutthepriorwrittenconsentoftheserviceprovider.This agreementandtherightsandobligationsmaybeassignedbytheserviceprovider withouttheconsentoftheowner,providedsuchassignmentistoanotherJetInc. certifiedserviceprovider. 13.) SeverabilityIfanytermorprovisionofthisagreementisdeemedtobeinvalidor unenforceable,suchadeterminationwillnotaffectanyoftheremainingtermsand provisions.Allsuchremainingtermsandprovisionswillremaininfullforceand effect. 14.) RequiredMediationAllpartieswillagreethatanydisputes,includingthe constructionorapplicationofthisagreement,shallbesubmittedtomediation betweentheserviceproviderandowner.Allitemsmustbefullydocumented.Ifthe mediationdoesnotresultinamutualsettlementwithinoneyearfromthedate submitted,eachpartyhastherighttoenforceobligationsinacourtoflaw.All reasonableattorneyfees,courtcosts,andexpensesincurredbytheprevailingparty aretobepaidinfullbytheotherparty,asallowedbytheapplicablelaw. 15.) ModificationsThetermsofthisagreementcanonlybemodifiedifallinvolvedparties havegivenawrittenagreement.
