Varied are the problems in India today, that still defy their solution. Since the year of
Independence, enormous developments in every field have taken place in our country. India being
a welfare state has tried and still trying through state intervention to remove their social evils.
Alexanderowicz rightly observed “A new constitution, like the score of a new orchestral work,
can not be fully understood by reading alone but waits for ‘performance through concerted
action’. Its success depends not only on faithful execution but also on its skillful and harmonious
application in practices”.
The constitution makers by making provisions in Article 15 and 16 adopted a policy of
compensatory discrimination as an equalizer to those who were too weak socially and
economically to compete and exist in a caste ridden society.
The main concern of the founding fathers of the Indian constitution was to create an
egalitarian society wherein ‘Justice - social, economic and political’ prevail and ‘equality of
status and opportunity’ are made available to all. It is not therefore surprising to find the spirit of
‘equality’ pervading the constitution. But since certain classes of Indian citizens were suffering
from several social and economic disabilities and as they could not effectively enjoy either
equality of status of opportunity, it was thought desirable that for such a period as they take for
catching up with the rest of the society, the constitution itself should provide for special treatment
to them for certain purposes. For this reason the Indian constitution provides for preferential
treatment for the ‘Deprived Castes’ while adhering to the principle of ‘equality’.
Government through various plans, policies and constitutional measures tries to fill the
gap existing in society between the upper and the deprived castes. But all the measures are
theoretical and in spite of these plans, policies and legislations the condition of these
downtroddens is still worse. Only a few of them have avail the opportunity provided through
these plans, policies and legislations. In existing conditions ‘Justice - social, economic and
political’ and ‘equality of status and opportunity’ has no meaning for them.
The policy makers, political elites and the bureaucrates plan the policies in such a way
that the existing condition should be maintained and the benefits should not be availed off by
them. They make the policies keeping the interest of their own group in mind.
If we examine the other side of the coin that is implementation of the plans, policies and
legislations we find that in the contemporary bureaucratic set-up of India, the benefits of these
plans, policies and legislations could not be availed off by the person concerned for whom these
are prepared.
In this study I have tried to analyse the plans, policies and legislations meant for the
upliftment of downtrodden. I tried to find out that whether these plans, policies and legislations
are beneficial for them or not. On the other hand I have also examined the way of implementation
of these plans, policies and legislations that whether they are implemented to help the
downtroddens or not.
An attempt has made to see that whether these are helpful for the upliftment of them or not, and
also to find out that what are those causes which are responsible for this state of affair instead of
all these efforts.
