Memorandum of Agreement

This Memorandum of Agreement establishes the City Schools Division of Talisay City between the City Government of Talisay and the Department of Education. The City will fund the construction of the division office and provide initial furniture, fixtures, equipment, personnel, and operating costs. The DepED will process positions for the division, designate an officer-in-charge, and assign education officials to operationalize the division. Both parties agree to cooperate in establishing the division in accordance with law.

Memorandum of Agreement

MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS: This Memorandum of Agreement was made and executed on the _____ day of _________ 2013, in the City of ____________________ , _____________________, by and between: The CITY GOVERNMENT OF TALISAY, a local government unit created and operating pursuant to R.A. 8489 duly represented herein by its City Mayor, Honorable ERIC M. SARATAN, M.D., hereinafter referred to as the City; -andThe DEPARTMENT OF EDUCATION, Region VI, a national government agency organized and existing under the laws of the Republic of the Philippines with office address at DepED Complex, Meralco Avenue, Pasig City, represented by its Honorable Secretary, Br. ARMIN A. LUISTRO, herein referred to as the DepED; WITNESSETH: THAT

WHEREAS, pursuant to Section 7C of Republic Act 9155 (Governance of Basic Education Act of 2001), a division shall consist of a province or a city which shall have a schools division superintendent and an office staff for programs and promotion, planning, administrative, fiscal, legal, ancillary and other support services; WHEREAS, the City Charter of Talisay, as amended by Republic Act 10456 Entitled AN ACT ESTABLISHING A SEPARATE CITY SCHOOLS DIVISION OFFICE IN THE CITY OF TALISAY, PROVINCE OF NEGROS OCCIDENTAL, AMENDING FOR THE PURPOSE REPUBLIC ACT NUMBER 8489, ENTITLED "AN ACT CONVERTING THE MUNICIPALITY OF TALISAY, NEGROS OCCIDENTAL, INTO A COMPONENT CITY TO BE KNOWN AS THE CITY OF TALISAY" under Sec. 50 provides for the establishment and maintenance of a school division within its territorial jurisdiction; NOW, THEREFORE, in view of the above premises and pursuant to the overall objective of the City of Talisay, Province of Negros Occidental, in the attainment of national goals particularly the delivery of quality basic education, the parties, hereby agree and bind themselves to work together in establishing the City Schools Division of Talisay City in compliance with law, subject to the following stipulations and commitments: A. The city shall: 1. Fund the construction of the City Schools Division Office; 2. Provide the necessary furniture, fixtures and equipments for the divisions initial operation; 3. Provide and maintain at is expense and on a co-terminus basis administrative personnel and support staff necessary for the operation of the City Schools Division until the national budget shall have provided enough to cover the salaries and other benefits of such personnel; and

4. Provide the maintenance and operating requirements of the City Schools Division until such time the funding are provided for in the General Appropriations Act (GAA). B. The DepED shall: 1. Process the creation of positions for the City Schools Division of Talisay City; 2. Designate and Officer In-Charge for the City Schools Division Office upon recommendation of the Regional Director, DepED Regional Office No. VI, City of Iloilo; 3. Designate education officials whose qualification, experience and probity can operationalize the City Schools Division, subject to the willingness of said officials to assume positions on a concurrent capacity; This MOA does not in any way prevent the parties from entering into the other stipulations as may hereafter be agreed to by the said parties. This Agreement shall take effect upon the signing hereof by the parties concerned and shall continue to remain valid and binding unless terminated by the parties upon prior written notice sent to the other at least thirty (30) days prior to the intended termination. No part or portion of this MOA shall be amended or modified without the written approval of the parties hereto.
