(e)"Prohibitedconduct"meansbullyingorcyberbullyingasdefinedunderthis subdivisionorretaliationforasserting,alleging,reporting,orprovidinginformationabout suchconduct. (f)"Remedialresponse"meansameasuretostopandcorrectprohibitedconduct, preventprohibitedconductfromrecurring,andprotect,support,andinterveneonbehalfof thestudentwhoisthetargetoftheprohibitedconduct.Districtsandschoolsmayseekthe assistanceoftheschoolclimatecenterundersection127A.052todevelopandimplement remedialresponsesonbehalfofastudentwhoisthetargetofprohibitedconduct,to stopandcorrectastudentengaginginprohibitedconduct,andforusewithstudentsand adultsintheschoolcommunity.Districtsandschoolsneednotreporttheuseofremedial responseswhentheiruseisunrelatedtoanyparticularincidentofprohibitedconduct. Subd.4.Localpolicycomponents.(a)Eachdistrictandschoolpolicyimplemented underthissectionmust,ataminimum: (1)designateastaffmemberastheprimarycontactpersonintheschoolbuilding toreceivereportsofprohibitedconductunderclause(3),ensurethepolicyandits proceduresincludingrestorativepractices,consequences,andsanctionsarefairlyand fullyimplemented,andserveastheprimarycontactonpolicyandproceduralmatters implicatingboththedistrictorschoolandthedepartment (2)requireschoolemployeesandtrainedvolunteerswhowitnessprohibitedconduct orpossessreliableinformationthatwouldleadareasonablepersontosuspectthata studentisatargetofprohibitedconducttomakereasonableeffortstoaddressandresolve theprohibitedconduct (3)provideaproceduretopromptlyinvestigatereportsofprohibitedconductwithin threeschooldaysofthereport,andmaketheprimarycontactpersonresponsibleforthe investigationandanyresultingrecordandforkeepingandregulatingaccesstoanyrecord (4)indicatehowaschoolwillrespondtoanidentifiedincidentofprohibited conduct,includingimmediatelyinterveningtoprotectthetargetoftheprohibitedconduct consistentwithstateandfederaldatapracticeslawgoverningaccesstoprivatedata,and, attheschooladministrator'sdiscretion,notifyinglawenforcementofficialsimmediately notifyinglawenforcementofficialsifthepersoninvestigatingareportofprohibited conductagainstastudentbyateacher,otherdistrictorschoolemployee,orschool volunteerreasonablybelievesthattheprohibitedconductagainstthestudentisacrime providingotherremedialresponsestotheprohibitedconductandensuringthatremedial responsesaretailoredtotheparticularincidentandnatureoftheconductandthestudent's developmentalageandbehavioralhistory (5)prohibitreprisalsorretaliationagainstanypersonwhoasserts,alleges,orreports prohibitedconductorprovidesinformationaboutsuchconductandestablishappropriate consequencesforapersonwhoengagesinreprisalorretaliation (6)allowanonymousreportingbutdonotrelysolelyonananonymousreportto determinediscipline (7)provideinformationaboutavailablecommunityresourcestothetarget,actor, andotheraffectedindividuals,asappropriate (8)whereappropriateforachildwithadisabilitytopreventorrespondtoprohibited conduct,requirethechild'sindividualizededucationprogramorsection504planto addresstheskillsandproficienciesthechildneedstoavoid,respondto,ornotengagein prohibitedconduct (9)usenewemployeetrainingmaterials,theschoolpublicationonschoolrules, procedures,andstandardsofconduct,andthestudenthandbookonschoolpolicies topublicizethepolicy (10)requireannualreporting,collection,andanalysisofsummarydataonincidents ofprohibitedconductandonremedialresponsesbothtostudentsandthroughouttheschool (11)requireongoingprofessionaldevelopment,consistentwithsection122A.60, tobuildtheskillsofallschoolpersonnelandvolunteers,including,butnotlimitedto, educators,administrators,schoolnurses,cafeteriaworkers,custodians,busdrivers, athleticcoaches,extracurricularactivitiesadvisors,volunteers,andparaprofessionalsto identify,prevent,andappropriatelyaddressprohibitedconductand (12)implementthefollowingstandardsrelatedtodataonincidentsofprohibited conduct: (i)apresumptionthatadistrictorschoolofficialwillnotifytheparentofanystudent affectedbyallegedprohibitedconductoffactsrelatedtotheincidentandanydisciplinary orremedialactiontakenbytheschoolordistrict,unlessnotificationtotheparentis otherwiseprohibitedbylawortheofficial,inconsultationwiththedistrict'sresponsible authority,determinesthatnotifyingtheparentisnotinthebestinterestofthestudent,as consistentwithsection13.02,subdivision8 (ii)establishmentofwrittenproceduresforaffectedstudentsandparentsofaffected studentstoaccessalldatamaintainedbytheschoolordistrictrelatedtotheincident, includingauthorizationforastudentorparenttocontesttheaccuracyorcompleteness

includingauthorizationforastudentorparenttocontesttheaccuracyorcompleteness ofthedata,consistentwithsection13.04,subdivision4 (iii)establishmentofascheduleforretentionanddestructionofdatarelatedto incidentsofprohibitedconduct,includingexpediteddestructionofdatarelatedto allegationsofprohibitedconductdeterminedtobewithoutfactualbasis (iv)establishmentofsecurityprocedurestoensurethat,exceptforsummary data,dataonincidentsofprohibitedconductarenotsharedwithordisseminatedto anyindividualorentitynotexpresslyauthorizedbylawtoaccessthedata,unlessan affectedstudentorthatstudent'sparentconsentstosharingordisseminationofdataon thatstudent'sinvolvementintheincidentforthespecificpurposeforwhichthedatawill besharedordisseminatedand (v)establishmentofprocedurestoensurethatdatadesignatedas"summarydata" complywithsection13.02,subdivision19,requiringthatthedatadonotidentifyan individualorcontaincharacteristicsthatcouldbeusedtoascertainanindividual'sidentity. (b)Professionaldevelopmentunderalocalpolicyincludes,butisnotlimitedto, informationabout: (1)developmentallyappropriatestrategiesbothtopreventandtoimmediatelyand effectivelyintervenetostopprohibitedconduct (2)thecomplexdynamicsaffectinganactor,target,andwitnessestoprohibited conduct (3)researchonprohibitedconduct,includingspecificcategoriesofstudentsatrisk forprohibitedconductinschool (4)theincidenceandnatureofcyberbullyingand (5)Internetsafetyandcyberbullying. Subd.5.Safeandsupportiveschoolsprogramming.(a)Districtsandschools areencouragedtoprovidedevelopmentallyappropriateprogrammaticinstruction tohelpstudentsidentify,prevent,andreduceprohibitedconductvaluediversityin schoolandsocietydevelopandimprovestudents'knowledgeandskillsforsolving problems,managingconflict,engagingincivildiscourse,andrecognizing,responding to,andreportingprohibitedconductandmakeeffectivepreventionandintervention programsavailabletostudents.Uponrequest,theschoolclimatecenterundersection 127A.052mustassistadistrictorschoolinhelpingstudentsunderstandsocialmedia andcyberbullying.Districtsandschoolsmustestablishstrategiesforcreatingapositive schoolclimateanduseevidencebasedsocialemotionallearningtopreventandreduce discriminationandotherimproperconduct. (b)Districtsandschoolsareencouragedto: (1)engageallstudentsincreatingasafeandsupportiveschoolenvironment (2)partnerwithparentsandothercommunitymemberstodevelopandimplement preventionandinterventionprograms (3)engageallstudentsandadultsinintegratingeducation,intervention,andother remedialresponsesintotheschoolenvironment (4)trainstudentbystanderstointerveneinandreportincidentsofprohibitedconduct totheschool'sprimarycontactperson (5)teachstudentstoadvocateforthemselvesandothers (6)preventinappropriatereferralstospecialeducationofstudentswhomayengage inprohibitedconductand (7)fosterstudentcollaborationsthatfosterasafeandsupportiveschoolclimate. Subd.6.Statemodelpolicy.(a)Thecommissioner,inconsultationwiththe commissionerofhumanrights,shalldevelopandmaintainastatemodelpolicy.Adistrict orschoolthatdoesnotadoptandimplementalocalpolicyundersubdivisions2to5 mustimplementandmaysupplementtheprovisionsofthestatemodelpolicy.The commissionermustassistdistrictsandschoolsunderthissubdivisiontoimplementthe statepolicy.Thestatemodelpolicymust: (1)defineprohibitedconduct,consistentwiththissection (2)applytheprohibitedconductpolicycomponentsinthissection (3)forachildwithadisability,wheneveranevaluationbyanindividualized educationprogramteamorasection504teamindicatesthatthechild'sdisabilityaffects thechild'ssocialskillsdevelopmentorthechildisvulnerabletobullying,cyberbullying, harassment,orintimidationbecauseofthechild'sdisability,thechild'sindividualized educationprogramorsection504planmustaddresstheskillsandproficienciesthechild needstoavoid,respondto,ornotengageinsuchconductand (4)encourageviolencepreventionandcharacterdevelopmenteducationprograms undersection120B.232,subdivision1. (b)Thecommissionershalldevelopandpostdepartmentalproceduresfor: (1)periodicallyreviewingdistrictandschoolprogramsandpoliciesforcompliance withthissection (2)investigating,reporting,andrespondingtononcompliancewiththissection,

(c)Departmentrecordsunderthissubdivisionareprivatedataonindividuals.An individualsubjectofthedatashallhaveaccesstothedataexceptthatthenameofa reporterisconfidential. (d)Thecommissionermustpostonthedepartment'sWebsiteinformationindicating thatwhendistrictsandschoolsallownoncurriculumrelatedstudentgroupsaccessto schoolfacilities,thedistrictorschoolmustgiveallstudentgroupsequalaccesstothe schoolfacilitiesregardlessofthecontentofthegroupmembers'speech. Subd.7.Relationtoexistinglaw.Thissectiondoesnot: (1)establishanyprivaterightofaction (2)limitrightscurrentlyavailabletoanindividualunderothercivilorcriminallaw, including,butnotlimitedto,chapter363Aor (3)interferewithaperson'srightsoffreespeechandexpressionundertheFirst AmendmentoftheUnitedStatesConstitution. EFFECTIVEDATE.ThissectioniseffectiveJuly1,2013. Sec.4.[121A.0311]NOTICEOFTHERIGHTSANDRESPONSIBILITIES OFSTUDENTSANDPARENTSUNDERTHESAFEANDSUPPORTIVE MINNESOTASCHOOLSACT. Adistrictorschoolsubjecttosection121A.031mustincludeinthestudent disciplinepolicyitdistributesorotherwisetransmitstostudentsandtheirparentsannually atthebeginningofeachschoolyearnoticeabouttherightsandresponsibilitiesofstudents andtheirparentsundertheSafeandSupportiveMinnesotaSchoolsAct. EFFECTIVEDATE.Thissectioniseffectiveforthe20132014schoolyearand later. Sec.5.MinnesotaStatutes2012,section121A.55,isamendedtoread: 121A.55POLICIESTOBEESTABLISHED. (a)Thecommissionerofeducationshallpromulgateguidelinestoassisteachschool board.Eachschoolboardshalltoestablishuniformcriteriafordismissalandadopt writtenpoliciesandrulestoeffectuatethepurposesofsections121A.031and121A.40to 121A.56.Thepoliciesshallemphasizepreventingdismissalsthroughearlydetectionof problemsandshallbedesignedtoaddresspreventstudents'inappropriatebehaviorfrom recurring.Thepoliciesshallrecognizethecontinuingresponsibilityoftheschoolforthe educationoftoeducatethepupilduringthedismissalperiod.Thealternativeeducational services,ifthepupilwishestotakeadvantageofthem,mustbeadequatetoallowthe pupiltomakeprogresstowardsmeetingthegraduationstandardsadoptedundersection 120B.02andhelppreparethepupilforreadmission. Sec.15.MinnesotaStatutes2012,section127A.42,subdivision2,isamendedtoread: Subd.2.Violationsoflaw.Thecommissionermayreduceorwithholdthedistrict's stateaidforanyschoolyearwhenevertheboardofthedistrictauthorizesorpermits violationsoflawwithinthedistrictby: (1)employingateacherwhodoesnotholdavalidteachinglicenseorpermitina publicschool (2)noncompliancewithamandatoryruleofgeneralapplicationpromulgatedbythe commissionerinaccordancewithstatute,unlessspecialcircumstancesmakeenforcement inequitable,imposeanextraordinaryhardshiponthedistrict,ortheruleiscontraryto thedistrict'sbestinterests (3)thedistrict'scontinuedperformanceofacontractmadefortherentalofrooms orbuildingsforschoolpurposesorfortherentalofanyfacilityownedoroperatedbyor underthedirectionofanyprivateorganization,ifthecontracthasbeendisapproved,the timeforreviewofthedeterminationofdisapprovalhasexpired,andnoproceedingfor reviewispending (4)anypracticewhichisaviolationofsections1and2ofarticle13ofthe ConstitutionofthestateofMinnesota (5)failuretoreasonablyprovideforaresidentpupil'sschoolattendanceunder MinnesotaStatutes (6)noncompliancewithstatelawsprohibitingdiscriminationbecauseofrace, color,creed,religion,nationalorigin,sex,age,maritalstatus,statuswithregardto publicassistanceor,disability,asdefinedinsections363A.08to363A.19and363A.28, subdivision10,ornoncompliancewithprohibitedconductundersection121A.031or (7)usingfundscontrarytothestatutorypurposeofthefunds. Thereductionorwithholdingmustbemadeintheamountandupontheprocedure providedinthissection,or,inthecaseoftheviolationstatedinclause(1),uponthe procedureprovidedinsection127A.43. EFFECTIVEDATE.ThissectioniseffectiveJuly1,2013. Sec.16.REPEALER. MinnesotaStatutes2012,sections121A.03and121A.0695,arerepealedeffective July1,2013.
