Course : LL.M. ( Final)

Note:

1. Students are advised to read the separate enclosed instructions, before attempting to write the
Assignment.


2. Out of 20 Internal Assignment marks per paper, 5 marks will be awarded for regularity (attendance) to
Counseling/Contact Programme Classes pertaining to the paper. Therefore, the topics given below
are only for 15 marks each paper.


3. ANSWERS must be brief and where ever required answers must be substantiated with relevant Case
Laws / Statutory Provision.

Answer any TWO Topics/ Questions from each of the papers. Each Topic carries 7 Marks.

Paper 7: Legal Regulation of Economic Enterprises

1. Freedom of Business, Trade and Profession is a guaranteed fundamental right. Comment on
the relevance of this statement in the light of rational of government regulation of economic
activities.


2. Industrial sickness has only two solutions- Nationalization or Winding up discuss the
rational of this statement in the light of measures adopted by the Government to overcome this
problem.


3. Capital is life blood of company Elucidate this statement with special reference to types of
capital and the procedure for its issue.


Paper 8: Law of Export Import Regulation

1. The costs and benefits of the emerging global economy are being hotly debated among
businessmen, economists and politicians. The debate focuses on impact of liberalization and
globalization on jobs, wages, environment, working conditions and national sovereignty.
Critically examine the implications on the above as a legal expert.


2. Critically examine the legal provisions pertaining to the levy of customs duties and also their
exemption.


3. Discuss the automatic approval schemes for technology transfer.


Paper 9: Banking Law

1. Explain the origin and development of banking in India.

2. The aim of nationalization of Banks in India is to control the heights of the economy and to
meet progressively and serve better needs of development of the economy in conformity with
the national policy and objectives. Elucidate.


3. Analyze the functions of Reserve Bank of India and its role in the development, control and
functioning of Banks.



Paper 10: Insurance Law

1. Discuss the role of Insurance Regulatory Authority in regulating insurance business in India.
2. What is meant by Liability insurance? Explain the different kinds of liability insurance
policies available in India.


3. State the consequences of non-disclosure and mis-representation of material facts in contract
of insurance.

Paper 11: Corporate Finance

1. What are the limitations of Profit maximization of objective and debate how Wealth
maximization objective is better.


2. Enumerate the important Public Financial Institutions which are assisting the companies for
their financial needs.

3. Explain the role of SEBI as regulator for primary market.


Paper 12:

Environment and Development: Policy and Law


1. What is sustainable development? How to resolve the conflict between development and
environment?


2.
Discuss the major international declaration on environmental protection.


3.
Critically evaluate the emerging concepts developed by judiciary on environmental issues.


Paper 13: Dissertation

There are no Internal Assignments for Paper 13. Candidates are to submit One Dissertation
which carries 80 Marks for the Project work and 20 Marks for Viva-Voce on the topic, which
they choose.

Instructions:
1. Students can choose any topic for the Dissertation work from the LL.M. Syllabi.
2. The Dissertation work can be either Doctrinal or Non-Doctrinal mode.
3. The Dissertation must be original contribution of the Candidate and must comply with all the
requirements. (Introduction, Hypothesis, Methodology, Citation, Foot note or Chapter notes,
Bibliography)
4. Get assistance or advice from Sr. Advocate or Professors locally and attach a Certification
with the Dissertation work.
5. Viva-Voce will be conducted after receipt of the Dissertation work. Date and Time of Viva-
Voce will be intimated by separate communication.
6. Printed and bound copy of the Dissertation work must reach The Director, Directorate of
Distance Education, Kuvempu University, Shankaraghatta 577 451, on or before
31

July 2014 Dissertation received after due date will not be considered for Valuation.
