STAFF - SUPERVISING - SALARY REVISION FOR OFFICER EMPLOYEES GOVERNED
BY OFFICERS' SERVICE REGULATIONS, 1979/1982 JOINT NOTE DATED 27TH
APRIL, 2010 SIGNED BETWEEN INDIAN BANKS ASSOCIATION AND OFFICERS
ASSOCIATION
A reference is invited to above-mentioned circular through which the extant
guidelines on salary & allowances and other service conditions of Officer
Employees were circularised.
On the basis of discussions and deliberations held between Indian Banks'
Association and representatives of Officers' Associations Viz., All India Bank
Officers' Confederation (AIBOC), All India Bank Officers' Association (AIBOA), Indian
National Bank Officers' Congress (INBOC) and National Organisation of Bank Officers
(NOBO), a Joint Note has been signed on 27th April 2010 on the salary revision
package. A copy of the Joint Note along with enclosures, being the details of
packages of salary revision for officers governed by the Officers' Service
Regulations in Public Sector Banks, is given in Annexure.
We have been advised by IBA that as the procedure for amending the Officers'
Service Regulations/Bank Employees Pension Regulations will take some time, in
order to give effect to the provisions of the Joint Note dated 27th April, 2010,
banks can disburse an ad hoc amount equivalent to the net arrears payable to the
officer employees as also continue to pay revised salary and allowances on an ad
hoc basis.
Branches/Offices may arrange to disburse to the debit of IBIT/F&A Department,
Head office, an ad hoc amount equivalent to the net arrears payable for the period
November, 2007 to April 2010 and further continue to pay the ad hoc amount equal
approximately to the increase in emoluments on the basis of month to month
calculations of old and revised emoluments from May 2010 onwards till formalities
for amending the Officers' Service Regulations are completed. The relative advices
along with the statement should be sent to the Controlling Authorities to reach not
later than 15th July, 2010.

Date of effect:It may be noted that for payment of arrears, the benefits under various provisions
in the Joint Note, shall be from the date of signing of the Joint Note, unless
otherwise specified against the relevant provisions.
The arrears calculation should be meticulously checked by a supervising official at
the branch/office.
Statement regarding arrears paid for the period from
01/11/2007to 31/03/2008 from 01/04/2008 to 31/03/2009, from 01/04/2009 to
31/03/2010 and from 01/04/2010 to 31/05/2010 should be submitted by the
branches/offices in the format enclosed duly certified as to the correctness to
their respective Controllers, who in turn will consolidate and submit to F & A.
Department at Head Office.
Branches/Offices should also forward in duplicate copies of the salary register
relating to arrears paid, to the respective Controllers for post confirmation.
Controllers, after verification return one copy to the disbursing officer for
verification by internal auditors/concurrent auditors. Auditors and Concurrent
Auditors are advised to involve themselves in verifying the correctness of
calculation of arrears.
The Zonal Offices in turn would furnish to F&A Department at Head Office,
endorsing a copy to P.A Department, Head Office, the consolidated figures of
arrears paid, giving details of payment made Controllerwise, branchwise and staff
categorywise in the format enclosed. In the case of Head Office Departments, the
figures should be furnished by Office Administration Department. This is a very
important statement called for by our statutory auditors and any laxity or delay
in submission of this statement will be viewed seriously.
CARE:It was agreed to extend one more option for existing employees to opt pension
scheme. In respect of employees who are in the service of the Bank as on 27th
April 2010 and presently covered by the Contributory Provident Fund, while making
payment of arrears, the following procedure is suggested for smooth
implementation of the Pension Settlement.
(i.) An amount equal to 2.8 times of the Pay for the month of
November, 2007 be withheld and kept in a suspense account for
crediting to the Pension Fund in case the employee opts to join the
Pension Scheme complying with the terms of the Settlement dated
27th April, 2010.
(ii.) If any employee gives in writing an irrevocable letter stating that he
does not intend to join the Pension Scheme, in terms of the
Settlement, 2.8 times of the November 2007 pay as above need not
be withheld.
(iii.) Once the offer is made to join the Pension Scheme, on expiry of the
period of option, the amount withheld in respect of those who have
exercised the option to join the Pension Scheme should be
transferred to the Pension Fund. The arrears withheld in respect of
those who did not opt for pension within the stipulated time, be
refunded to them.

(iv.) No

portion of arrears be withheld in respect of non-optee


employees who retired from 01st November 2007 to 27th April, 2010.
They will be joining the Pension Scheme by making contribution
towards funding gap as retired employees in terms of the
Settlement.

Further details regarding the pension scheme will be advised later.


In the joint Note, clause 7.3 (i) on rate of Dearness Relief Payable w.e.f. 01st May,
2005 to officers who retired during the period 01.04.1998 to 31.10.2002, the table
given therein be substituted with the following.

REIMBURSEMENT OF SPECIAL HOSPITALISATION:On and from 01st May, 2010, reimbursement of hospitalisation expenses under
Regulation 24(1)(b)(i) of Officers' Service Regulations, 1979.1982, shall be in terms
of the Hospitalisation Scheme laid down under Bipartite Settlement dated 27th
April, 2010 for workmen employees, subject to following limits.

The details of revised reimbursement of hospitalisation expenses available to
award staff is given under Schedule - V of the Annexure, for easy reference.

As regards payment of arrears in respect of officers who ceased to be in service


of the Bank on or after 01.11.2007, they may be paid arrears of salary revision
on ad hoc basis, pending amendment of SBTOSR.
Officers in service, who had encashed Privilege Leave between 01.11.2007 till
implementation of the revised salary, may be paid arrears on eligible components
for the relevant period.
Officers who were placed under suspension prior to date of salary revision (i.e.
01/11/2007) should not be given the benefit of allowance. In other words, the
officer placed under suspension prior to 01.11.2007 shall continue to draw
subsistence allowance on the pre-revised salary only. However, where an officer
was placed under suspension on or after 01.11.2007, his provisional fitment in the
revised scale may be done as on 01.11.2007. Consequently, the subsistence
allowance payable to him may also be recalculated on the basis thereof and
resultant arrears of salary and subsistence allowance if any, should be paid to him.
Officers who are making additional contribution to Provident Fund in terms of
Regulation 8(3) of State Bank of Travancore Employees Provident Fund
Regulations, 1969 have been permitted to opt, if they so desire, not to make
additional contribution of arrears of salary for the period 01/11/2007 up to the month
of payment of arrears on account of salary revision. Further, they have also been
permitted to opt for appropriation of the additional contribution already made by them
between 01/11/2007 up to the month of the payment of arrears of compulsory
contribution required to be made by them in terms of Regulation 8(3) of SBT
Provident fund Regulations, 1969.
Please exercise caution at the time of calculating arrears in respect of the
following cases.
(a) Sick Leave/Leave on loss of pay.
(b) Absence due to strike etc.
(c) Regarding Stagnation Increment, it may be noted that the present
number of stagnation increment has been increased as given below.

the service or retired between 01/11/2007 to 27/04/2010) because of
the revision of salary, the same may be paid only after the sanction for
increment is obtained from appropriate increment sanctioning authority.
(d) In the case of officers on deputation to our Bank, arrears may be paid
only after getting proper and authenticated records. The arrears of
salary and allowances may be paid at our Bank and the amount of salary
& allowances for the period he was attached to the Parent Bank/Other
Bank is to be claimed from the respective Bank/s by the salary disbursing
authority.

(e) PF deductions made from ad hoc payment may be credited to the PF


account of the officer. In the case of staff who retired in between
01/11/2007 to 30/04/2010, the arrears on Provident Fund Contribution
need not be credited to PPFG Section, HO and may be paid to the retired
officer direct, along with Banks contribution.
(f) Deduction of income tax at source should be done as per extant
instructions.
Please note to bring the contents of this circular to the notice of all staff attached
to your branch/department and be guided accordingly.
