PREAMBLE
We, the students of this premiere institution Mariano Marcos State University,
Batac City, Ilocos Norte, by the Grace of God Almighty, unite ourselves to establish a
legitimate student governing body that shall guard the general welfare of the whole
studentry, uphold the ideals of our institutions, represent the students in civic-oriented
activities in conformance to university policies with integrity, address the needs and
problems of the students, develop solidarity and camaraderie among ourselves, under the
rule of law do ordain and promulgate this constitution and by-laws.
ARTICLE I
GENERAL PROVISIONS
SECTION I. The organization shall be known and henceforward be called MMSU
College of Medicine Student Council.
SECTION II. The MMSU College of Medicine Student Council shall be the
administrative, parliamentary, executing and coordinating body of all its members with
the vision of promoting student welfare and involvement in activities for inclusive
growth. It is geared towards creating a training ground for future medical doctors
conducive to the realization of the goals of this organization.

ARTICLE II
DECLARATION AND PRINCIPLES AND OBJECTIVES
SECTION I. This student body will strongly adhere to the principles of democracy.
SECTION II. The MMSU COM-Student Council will stand autonomous and democratic
but adhering to the persisting standard operating procedure of the university.
SECTION III. The College of Medicine serving the MMSU, is committed for the
favorable relationship between the school administration and this organization. The
organization accomplishes its mission and vision with the following objectives:
a. To work with the school administration on matters relative to the welfare of the
students
b. To serve as a forum for members to air grievances for quality education
c. To generate funds for projects and programs for the interest of the school and the
students.
d. To encourage and make use of members optimal potential
e. To uphold the morale of each member
f. To promote solidarity among members
g. To undertake programs which are beneficial to the organization, University as
well as to the community.
ARTICLE III
MEMBERSHIP
SECTION I. All students of MMSU College of Medicine who are currently enrolled in
the program, Doctor of Medicine, regardless of age, gender civil status, race
socioeconomic background and religion are automatic members of the organization.
SECTION II. Membership fee shall be collected from the members every school year, to
be collected and be determined by the Body (as per guidelines of the Student Services
and Development) for the approval of the General Assembly. Membership fee shall be
implemented the school year after the approval and shall be collected within two weeks
after the inauguration of the new set of officers.
SECTION III. All graduates of this program shall be automatically members of the
alumni and shall have the right to attend board meetings, general assembles and special
meetings as such with proper coordination.
SECTION IV. All members must be knowledgeable and properly attuned with their
rights, obligations and duties as stated on Article IV.
ARTICLE IV
RIGHTS, PRIVILEGES AND DUTIES
SECTION I. All members are entitled of the following rights and privileges:
a. All members shall have the right to information on matters concerning the
organization.
b. All members shall have the right to participate and cooperate to activities conducted
by the organization.
c. All members shall have the right to uphold and defend the organizations constitution
and bylaws.
d. All members shall have the right to engage in discussions concerning the organization
matters without reservations or fear of interloping.
e. All members shall be treated under due process of law
f. Expulsion disqualification withdrawal or graduation of any student from the College
of Medicine shall automatically forfeit the membership of the organization.
SECTION II. Members of this organization have the following duties and obligations:

SECTION I. There shall be a general assembly composed of members stated in Article III
of this constitution. It shall confirm any proposed policy and activity as well as the
method of implementation except in certain cases as specified in Article VI Section ----(re
Adviser)
SECTION II. There shall be a body known as the Executive Board composed of the
President, Vice President for Internal Affairs, Vice President for External Affairs,
Secretary of the Board, Treasurer, Business Affair Officers, Internal Auditor, Legal
Officer, Public Information Officer, Athletic and Cultural Affairs Officer, and Year Level
Representatives.
SECTION III. The members of the board shall assemble at a time and place designated
by the Dean of the college whose certification and proclamation of the duly elected
members shall be final.
SECTION IV. There shall also be standing committees which shall work for and
implementing the policies and decisions made by the organization. The standing
committee shall be the following:
Committee for Internal Affairs. The sole responsibility of this committee is geared
towards designating and fronting all tasks and responsibilities that comes during the
conduct of organizational activities. It shall have for its head the Vice President of
Internal Affairs.
Committee for External Affairs. This committee shall be responsible and liable in
coordinating out all tasks outside the organization. The Vice President for External
Affairs shall be the spearhead of this committee.
Committee for Finance. It shall take charge of all the financial matters of the
organization. It shall be headed by the Treasurer of the board.
Legal Committee. This committee shall undertake the following:
a. maintain the peace and order,
b. investigate conflicts, grievances and any violations concerning of this
constitutions,
c. be able to have a profound understanding of the constitutions and
bylaws and be able to interpret it,
d. be responsible in updating the organization with the prevailing legal
and standard operating procedures of the university regarding
organizational matters.
It shall have for its head the Legal Officers.
Committee for Business Affairs. This committee shall be responsible for business
functions related to the organization which includes developing, coordinating and
implementing income generating activities. The Business Affairs Officers shall be the
head of this committee.
Committee for Public Information. The committee shall be the source of
information vis--vis the organization and related matters. The Public information officer
will be the head of the committee.
ARTICLE VI
THE OFFICERS AND TERMS OF OFFICE
SECTION I. The officers stated on Article V Section II shall be elected from the regular
students and shall serve a term of one academic year after a new set of officers shall again
be elected.
SECTION II. Officers must be enrolled in at least half of the academic load units of
his/her school year during the time of election.
SECTION III. The President, Vice President for Internal Affairs, Vice President for
External Affairs, Secretary of the Board and Treasurer are the major key positions of the
organization while the rest assumes a minor role.
SECTION IV. Officers of the organization shall be limited to one major position and two
minor positions.
SECTION V. The officers shall hold office immediately after induction and it shall be
terminated as when another set of officers is elected and inducted into office or when
Section VII of this Article shall be applied.
SECTION VI. An ex-officio may run and be not prohibited from it for the next election
as long as he/she doesnt have a failing grade and have complied on Section II of this
Article.
SECTION VII. Should the officers wish to extend their term for another academic year it
shall be subjected to public forum with the whole studentry and the organizational
Adviser.
SECTION VIII. Any vacancies among the representatives due to the following reasons
such as disqualification resignation and expulsion from the college or any permanent
incapacity of role performance shall be filled by the qualified candidate gaining the
highest number of vote during election, provided, that in case of two or more
representatives, special election shall be called for by the Executive Board.
Section IX. A vacancy in a presidential position shall be filled by the automatic
assumption of the Vice President of Internal Affairs, provided however, that during a
simultaneous vacancy on both offices special election shall be conducted as the same
manner above.
SECTION X. The representatives elected to assume the vacancy of the officers who are
disqualified, expelled or have the incapacity of role performance shall hold office only
for the remainder of the unexpired term.
ARTICLE VII
DUTIES AND REPONSIBILTIES OF THE OFFIICERS
SECTION I. The MMSU College of Medicine Student council shall create and
implement policies which should not be opposing to the University rules, guidelines and
objectives.
SECTION II. The President elect shall:
a. serve as the executive of the student council;
b. call and preside over the General Assembly and all organizational meetings;
c. be responsible for appointing and be the overall chairman in all standing, special
and ad-hoc committees
d. affix his/her signature in all communications and carrying out orders of the
organization;
e. be the automatic representative of the organization in all external activities unless
otherwise choose to appoint an officer on his/her behalf;
f. render annual report to the constituency;
g. prepare and evaluate plans with the help of other officers;
h. approve all vouchers for the withdrawal of expenditure funds of the organization;
i. be empowered to create committees for specialized functions;
j. veto plans or decisions he/she deems appropriate or detrimental to the
organization together with the four other major officers stated in Article VI
Section III;
k. solely attest the truthfulness of all resolutions made by the organization; and
l. perform such other functions not limited to the above stated duties, as it may
deem necessary.

SECTION IV. An amount of ----- shall be collected as fine to every member who failed to
attend to college functions, unless valid reasons as such health problems or conflict of
religious belief accompanied by valid certification shall be excused.
SECTION V. Furthermore, an amount of ---- as fine when a member missed a major
activities such as College Socialization and MedBall. However, he/she may choose to pay
the penalty or academic absence. (or tres na grade sa lahat ng subject nya)
SECTION VI. For sports and cultural related activities, an amount of --------- will be

ARTICLE XI
MEETINGS
SECTION I. Regular meetings shall be held once a moth. However, general meetings
with the electorate shall be conducted at least once every two months.
SECTION II. Special council meeting shall be called so by the President or upon the
request of three or more members. This may or may not be open to electorate hearing
depending upon the discretion of the five major key position holder of the Board.
SECTION III. A penalty of 100Php shall be imposed to any officer who failed to attend
every regular meeting. He/she shall explain to the council his/her plausible excuse for not
attending such.
And he shall crack some jokes and if the majority shall not laugh his fine will be doubled
SECTION IV. In case the President can not preside the meeting or the latter is absent, the
Vice President for Internal affairs shall take over.

ARTICLE XII
IMPEACHMENT OF OFFICER, SUSPENSION AND EXPULSION OF
MEMBERS
SECTION I. Impeachment is the act of charging an elected officer with violation of trust
of his/her office. Final verdict shall not exceed further than the removal from office and
disqualification to ho hold any elective office in the organization. However, as such shall
be subjected to due process of law.

SECTION II. The following shall be the grounds for impeachment but not limited to:

negligence of duty;
gross incompetence;
usurpation of abuse of power; and
other highly questionable and unprofessional conduct
SECTION III. The council shall be the authority in conducting all impeachment
proceedings. The Officer or an member who has been charged shall be given seven days
of written notice prior to hearing to the charges pressed against him and shall have the
right to be heard at such meetings.
SECTION IV. The impeachment proceeding shall have the President as the Chairman
unless otherwise, he/she has to be tried against the charges. Therefore, the Vice President
of Internal Affairs and Legislative Officer shall take over.

SECTION V. First hearing shall be conducted by the Officers of the Board before the
case shall be subjected to electorate hearing. As such may not proceed, when upon the
first hearing, substantial evidences that shall rectify the situation be presented.
SECTION VI. The members of the council sitting in the session by a vote of of the
total electorate shall have the power to impeach, suspend and expel.
SECTION VII. The following shall be grounds for suspension of an officers for not more
than three months but no less than two:

c. insubordination
ARTICLE XIII
AMMENDMENTS
SECTION I. This constitution and bylaws shall be amended by 2/3 votes of the officers.
SECTION II. No law shall be implemented unless 2/3 votes of the officers shall be casted
and so with the approval of the Adviser.
SECTION III. Amended constitution shall take effect immediately after the inductions of
officers whom amended the constitution and by laws.
