‘The following are the violations at issue:
1, Hawaii Revised Statutes § 11333(a) quired candidates and treasurers of candidate
committees to report all contributions deposited, and expenditures made, during 3
preliminary, final oF supplemental reporting period
2 Hawa Administrative ules (HAR) §3-160-203), provides that a candidate or treasurer of
Committee must certy that the disclosure reports are tue and accurate statements ofthe
‘committee’ activity during the reporting period
3. Under Hawall Reise Statutes § 11-3513], monetary contributions must be promty
‘deposited in a depository institution. Under Hawai Administrative Rules §3-160-30(),
‘contributions must be deposited na later than seven days after receipt bythe candidate or
anyone authorized by the andidat to receive contributions
Allthe aforementioned violations are misdemeanors.
STATEMENT BY KRISTIN IZUMI-NITAO AND GARY KAM,
Kristin eumi-Nitao and Gary Kam presented the following information in this meeting:
1, They requested that the Department of the Attorney General accepts the criminal
referral ofthe Campaign Spending Commission and conduct a criminal investigation
fon House of Representative member, James Kunane Tokioka (hereinafter referred to
as Tokioka). Tei administrative investigation identified that Tokioka and his
treasurer, lan Caltano {hereinafter referred to as Caitano), were in volations of
incidents of False Name Contribution, an Fal To Timely Deposit Contribution

Under Hawaii Revised Statutes § 11-351(a), monetary contributions must be
promptly deposited ina depository institution. Under Hawaii Administrative
Rules §3-260-30(0), contributions must be deposited no later than seven dave
after receipt by the candidate or anyone authorized by the candidate to
receive contributions.
2. Hawaii Revised Statutes § 11-611 provides that in lie of administrative
determination, the Campaign Spending Commission may refer a matter for
‘prosecution if it believes that Tokioka recklessly, knowingly, or intentionally violated
the campaign finance law. Kristin laumi-Nitao and Gary Kam, ater receiving
«complaints from the public about Tokioka, conducted an investigation by

statute that required the candidates and treasurers to report ll contributions
and expenditures,
6 Caitane also knew that that Tokioka withheld contribution information fram
him but decided to flea zero report just to get the report in on time. Csitano
Intended to amend the report later after Tokioka gave him the information.
Krstn umi-Nitao, believed based on this, Caitano knowingly filed a fase
report.
3. They examined Tokioka’s 1" Preliminary Report (2/1/14 to 6/30/14) and discovered
‘that on 06/27/14 there was a contribution from G.A, Moris, Inc. nthe amount of

Tokiok listed the receipt ofthis check on 07/14/14. Kristin Izumi-Nitao
determined that this contribution made by Altria Client Services was a violation
‘of Hawali Revised Statute §11-352, False Name Contribution, in that, Tokioka
initially named G.A. Morris, Inc. as the contributor and not Altria Client
Services Tokioka was also in violation of §3-160:30, Hawaii Administrative
Rules for Failure to Timely Deposit Contribution. kristin Izumi-Nitao discovered

contribution information from him, but Caitano still decided ta file a zero

this conduct, Kristin zumi-Nitao and Gary Kam believed that Caitano, in his

Report (07/01/13 through 12/31/13) and discovered the report dated 10/29/13

1, He was responding based upon the four complaints sent to him as well asthe
“untimely deposit of checks.”
2. Concerning the fist fundraiser on 03/18/14, ad the second fundraiser an 06/27/14,
his campaign treasurer lan Caitano was not listed asthe "Person in Charge of
Fundraiser’ for either event, therefore was not aware that either event was to occur,
3. Anew campaign volunteer, who was new to “fundraisers” andits proces, did catalog
allcontrbutios received forthe two fundraisers, but the information was not
transmitted to Caitano,
4, Caltano then filed the original 1" Preliminary Primary Report reporting zero
Contributions, not knowing that the fundraisers had taken place.
‘3. Topprevent this from occuring in future, they have adjusted thelr SOP to
include that a copy of any future Form CC-8 be transmitted to the campaign
treasurer
5, Tokioka explained that once he was apprised ofthis, he immediately contacted
Caitano and they made every effort to correct the error ina timely manner. As they
were compiling the information for submission, they found that supplementary
Information was necessary to complete the report as specified by the Commission.
Specifically, additonal information needed tobe obtained from a couple of donors
‘who had contributed over one thousand dollars. On 08/29/14, once the
supplementary donor information had been obtained, they submitted arevised 1"
Preliminary Primary Report.
6. Tokioka stated that regarding the untimely deposits of checks, this was bis error as he
‘was not aware that the checks received at the fundraisers had to be deposited within
seven days. He has since been advised an HAR 3-160-308,
a. Furthermore, his home address serves as the campaign address, and, because
is oficial duties necessitates his physical presence on Oahu for certain period
of time, checking his mal at his home does not occur ona regular schedule, To
correct this, they willbe obtaining an official USPS box located on Oahu
specifically for his campaign. This will allow Caitano to receive ary checks
‘mailed tothe campaign directly, catalog and deposit them ina timely manner.
