‘THIS COURT, having heard and considered defense counsel's ore temus Motion for
Nolte Prosequi, and the Court being otherwise fully advised in the premises, finds that the
motion is not well-taken and should be DENJED, based on the following:
This matter was set for a plea hearing on Jemuary 7, 2015, and in advance of that docket,
the District Attomey presented the Court with an Order of Nolle Prosequi. See “Exhibit A,"
attached, No motion was presented with the proposed order in violation of Rule 6.07 of the
Uniform Circuit and County Court Rules." A hearing was held on January 22, 2015, at the
conelasion of which the undersigned instructed the parties to submit a detailed, written Motion
for Nolle Prosequi for his consideration along with documentation supposting the propriety of
the order, within ten (10) days. The motion and supporting information was due to the Court no
later than Monday, February 2, 2015 and as of the date of this Order, no such information has
deen submitted? As the movant failed to comply with the order of this Court and URCCC 6.07,
the Court find that the matter is not well-taken and should be DENIED.
" URCCC 6.07 states that “[alp apalication tothe cour for an order shall be by motion, which, unless made during a
bearing or trial, shal be made in writing, shall state with porticulrity the ground therefor, and shall set forth the
feliet oF order Sought. The requirement of writing is fulfilled she motion is stated in a writen notice ofthe hearing
of the motion or ifthe matter is presented in an agreed order,
