A Large portion of the Board of Health day to day actives are code enforcement. We spend a lot of time dealing
with owners and occupants to achieve compliance.
Some cases are easily resolved with a simple phone call or letter. Other cases may need multiple letters and
eventually have to go housing court.
Some of the larger cases involve abandoned properties with no owner or extremely hard to contact owners. (ie
no phone numbers or forwarding address). Also bank properties can be troublesome with out of state contacts
and out of state property preservation teams.
Often times with foreclosed properties and property title transfers can halt our enforcement and make us chase a
new owner.
Some complaints we receive, while they may be an eye sore to some, simply cannot be enforced because they
do not constitute a violation per code.
High Street Martowski:
Oder to clean issued December 2012.
Request sent for probable cause hearing in June 2013. 1st Court date appearance was on July 2013.
On August 2015 an order for The town to clean and lean the property was issued.
Property was foreclosed around the same time and the court order was not enforceable.
Currently working with the bank and the property preservation team to clean up the property. Also currently
waiting for eviction of all tenants so work can begin.
Outcome: May have to start court proceedings with the bank.
1095 Thorndike Street:
House was condemned by Board of Health in 2009.
Code enforcement started February 2013.
Outcome: House demolished in March 2015.
27 Fox Street:
House was condemned by Board of Health in February 2013.
Through court order house was appointed a receiver in July of 2015.
Outcome: The house has been restored to full compliance and is on the market for sale.

Outcome: Probable cause Hearing May 23rd 2015.
249 Ware Street:
Trailer had a fire in November of 2012.
Code enforcement started February 2013.
Outcome: The condemned structure has been demolished and is in new construction and almost complete
2 Belchertown Street:
House had a fire in .. The Board of Health condemned in 2011.
Code enforcement started May 2013.
Condemned property was sold in June of 2014.
Outcome: The condemned structure has been demolished and is in new construction and almost complete.
37-39 Belchertown Street
House was condemned by the Board of Health in November 2012.
Property was cleaned in January 2013 and has been maintained by property Preservation Company.
Outcome: Demand notice for appointment of receiver sent and bank response on May 2016. (Pending
receivership)

258 Breckenridge Street


House was condemned by the Board of Health in June 2014.
Outcome: Currently pending approval for a demolition permit.
51 French Drive
Trailer was condemned by the Board of Health in April 2014.
House vacant and was boarded and secured in May 2014.
Outcome: On list for receivership
79 Pinney Street
Code enforcement started April 2013.
House is over $80,000 and beyond disrepair. All potential receivers have not been interested due to high cost.
Outcome: Stalemate recommends tax title taking and auction

House condemned by the Board of Health in July 2013.
House was secured in September 2013. House was sold in 2014.
Outcome: The house is currently being remodeled with all proper permits.
29 Sylvia Street
House condemned by the Board of Health in January 2015.
Outcome: Property was cleaned in April 2015 and has been maintained by property Preservation Company.

Outcome: Property is currently undergoing de-leading and asbestos testing prior to obtaining a demolition
permit.
