William Terry Johnson v. W.D. Blankenship, Warden, 952 F.2d 1396, 4th Cir. (1992)

This document is a court case from the United States Court of Appeals for the Fourth Circuit from January 24, 1992. It involves an appeal by William Terry Johnson of the district court's denial of his petition for a writ of habeas corpus. The appeals court denies Johnson a certificate of probable cause to appeal and dismisses the appeal, agreeing with the reasoning of the district court that denied Johnson's habeas petition. The appeals court finds the appeal is without merit and oral arguments would not aid the decision.

William Terry JOHNSON, Petitioner-Appellant,
v.
W.D. BLANKENSHIP, Warden, Respondent-Appellee.
No. 91-7701.

United States Court of Appeals, Fourth Circuit.

Submitted Jan. 10, 1992.
Decided Jan. 24, 1992.

Appeal from the United States District Court for the Western District of
Virginia, at Roanoke. Jackson L. Kiser, District Judge. (CA-90-745-R)
William Terry Johnson, appellant pro se.
Virginia Bidwell Theisen, Office of the Attorney General of Virginia,
Richmond, Va., for appellee.
W.D.Va.
DISMISSED.
Before K.K. HALL and PHILLIPS, Circuit Judges, and BUTZNER,
Senior Circuit Judge.
OPINION
PER CURIAM:

William Terry Johnson seeks to appeal the district court's order refusing habeas
corpus relief pursuant to 28 U.S.C. 2254. Our review of the record and the
district court's opinion discloses that this appeal is without merit. Accordingly,

we deny a certificate of probable cause to appeal and dismiss the appeal on the
reasoning of the district court. Johnson v. Blankenship, No. CA-90-745-R
(W.D.Va. Aug. 28, 1991; Sept. 17, 1991). We dispense with oral argument
because the facts and legal contentions are adequately presented in the
materials before the Court and argument would not aid the decisional process.
