Donald Ray Bass v. R.M. Muncy, Warden, 851 F.2d 356, 4th Cir. (1988)

This document is an unpublished appellate court decision from 1988 denying Donald Ray Bass's petition for habeas corpus relief from his conviction. The appeals court reviewed the district court record and found Bass's appeal to be without merit. It therefore denied his request for a certificate of probable cause to appeal and dismissed the case based on the reasoning provided by the district court in its previous opinion.

Donald Ray BASS, Petitioner-Appellant,
v.
R.M. MUNCY, Warden, Respondent-Appellee.
No. 88-6576.

United States Court of Appeals, Fourth Circuit.

Submitted: June 8, 1988.
Decided: July 6, 1988.

Elizabeth Harding Dashiell, Michael Morchower (Morchower, Luxton &

Whaley), for appellant.
Robert Homer Anderson, III (Office of the Attorney General of Virginia),
for appellee.
Before DONALD RUSSELL, WIDENER and SPROUSE, Circuit Judges.
PER CURIAM:

Donald Ray Bass seeks to appeal the district court's order refusing habeas
corpus relief pursuant to 28 U.S.C. Sec. 2254. Our review of the record and the
district court's opinion discloses that this appeal is without merit. Accordingly,
we deny a certificate of probable cause to appeal and dismiss the appeal on the
reasoning of the district court. Bass v. Muncy, C/A No. 87-513-R (E.D.Va. Feb.
29, 1988). We dispense with oral argument because the facts and legal
contentions are adequately presented in the materials before the Court and
argument would not aid the decisional process.
DISMISSED.
