United States v. James L. Conley, 865 F.2d 1260, 4th Cir. (1988)

This document is a court case summary from the United States Court of Appeals for the Fourth Circuit. It summarizes a decision to affirm a lower district court's refusal of relief to James L. Conley under 28 U.S.C. Sec. 2255. The appeals court found no merit in Conley's appeal after reviewing the record and lower court opinion accepting the magistrate's recommendation. The appeals court affirmed the lower court's decision based on the reasoning provided in United States v. Conley, CR No. 82-173-A (E.D.Va. Mar. 29, 1988).

UNITED STATES of America, Plaintiff-Appellee,
v.
James L. CONLEY, Defendant-Appellant.
No. 88-7605.

United States Court of Appeals, Fourth Circuit.

Submitted: Sept. 29, 1988.
Decided: Dec. 14, 1988.

James L. Conley, appellant pro se.

Joseph John Aronica (Office of the U.S. Attorney), for appellee.
Before DONALD RUSSELL, JAMES DICKSON PHILLIPS and
MURNAGHAN, Circuit Judges.
PER CURIAM:

James L. Conley appeals from the district court's order refusing relief under 28
U.S.C. Sec. 2255. Our review of the record and the district court's opinion
accepting the recommendation of the magistrate discloses that this appeal is
without merit. Accordingly, we affirm on the reasoning of the district court.
United States v. Conley, CR No. 82-173-A (E.D.Va. Mar. 29, 1988). We
dispense with oral argument because the facts and legal contentions are
adequately presented in the materials before the Court and argument would not
aid the decisional process.

AFFIRMED.
