Classification of Felonies

Felonies in the Philippines are classified into three categories - grave, less grave, and light. Grave felonies carry afflictive penalties such as reclusion perpetua (20+1 to 40 years imprisonment) or life imprisonment (30 years maximum) and include crimes like murder and carnapping. Less grave felonies carry correctional penalties ranging from prison mayor (6+1 to 12 years imprisonment) to prison correccional (6 months and 1 day to 6 years imprisonment). Light felonies carry light penalties such as arresto menor (1 day to 1 month imprisonment) or public censure. Regional trial courts have jurisdiction over cases with penalties of 6+1 years imprisonment or more while lower courts

1. Grave: Afflictive Penalties: Death Penalty (Repealed 2 June 2006) CAPITAL PUNISHMENT
Reclusion Perpetua (20+1 to 40 years) = RPC
Life Imprisonment (30 years max) = Special Penal Laws
Reclusion Temporal (12+1 to 20 years)

X: Murder, Carnapping, Rape

2. Less Grave: Correctional Penalties: Prison Mayor (6+1 to 12 years)


Prison Correccional (6mos+1 to 6 years)
Suspension (6mos+1 to 6 years) PUBLIC OFFICIALS
Destierro (6mos+1 to 6 years) 25km to 250km
Locked out; Not a Penalty but a Protection
Arresto Mayor (1mo+1 to 6mos)
3. Light: Light Penalties: Arresto Menor (1day to 1mo)
Public Censure
Bond to keep peace
