FACTS:
-Moya was elected mayor of Paracale winning with
a margin of 102 votes in the general elections held
on December 14, 1937.

-Del Fiero filed a motion of protest in the CFI of


Camarines Norte on December 27, 1937.
-The Court of Appeals rendered a decision on July
13, 1939 which overturned the victory of Moya over
Del Fiero.
