20 Code of Civil Procedure. Cross-Complainants hereby ask leave of the Court to amend this Cross-

Complainant to allege the true names and capacities of such defendants at such time as the same have
22
been ascertained. Cross-Complainants are informed and believe and based upon such information and
23
belief allege that Cross-Defendants ROES 1 through 100 at all times mentioned herein, are making a
24
25 claim to the promissory note described herein below, which is conflicting with the claims of named
26 Cross-Defendants herein.
