MOTION

ON BEHALF OF RESPONDENT: Linda M. Osberg-Braun, Esquire

APPLICATION: Recalendar; termination of proceedings

In a decision dated August 15, 2013, this Board ordered these proceedings administratively
closed in the exercise of prosecutorial discretion. Now, the respondent (the recipient of an
approved 1-140 Immigrant Petition for Alien Worker, and dependent spouse of an alien recently
granted adjustment of status on an approved 1-485) has filed a motion to re-calendar, reinstate,
and terminate these proceedings without prejudice so that the respondent can pursue an
adjustment of status application before the United States Customs and Immigration Services
("USCIS"). The Department of Homeland Security ("OHS") has not filed an opposition to this
motion, and thus it is deemed unopposed. 8 C.F.R. I003.2(g)(3). Accordingly, the unopposed
motion will be granted.

ORDER: The Board's August 15, 2013, decision is hereby vacated, these proceedings are
terminated without prejudice, and the record is returned to the Immigration Court without further
action.
