awardedawomanRM300,000indamagesforbreachofherconstitutionalrighttogender
equalityafterthegovernmentrefusedtoemployherasatemporaryteacherwhenshe
becamepregnant.
Thegovernmentwasalsoorderedtopay32yearoldNoorfadillaAhmadSaikin
RM12,907.68forlossofearnings,RM2,296.10forlossofEPF(EmployeesProvident
Fund),RM912.71forlossofEPFdividends,aswellasRM25,000forpainandsuffering,
andRM5,000incosts.
ItisonesmallstepforNoorfadilla,butonegiantleapforwomensrightsinMalaysia,
NoorfadillaslawyerHoneyTantoldMalayMailOnline.
Therehaveneverbeendamagespaidforbreachofconstitutionalrightsbeforethis.This
decisionhasmadegreatinroadsintothedevelopmentofMalaysianjurisprudenceinthe
areaofhumanrightslaw,sheadded.
TansaidthecourthadawardedNoorfadilla,ahomemakerwithfourchildren,damagesfor
breachofArticle8(2)oftheFederalConstitutionthatprohibitsgenderdiscrimination.
Noorfadillasuedthegovernmentin2010afterHuluLangatdistricteducationofficers
revokedherappointmentin2009asatemporaryteacheronamonthtomonthbasisupon
discoveringherpregnancy.
TheShahAlamHighCourtruledin2011thatthegovernmenthaddiscriminatedagainst
Noorfadillaand,inalandmarkdecision,heldthattheUnitedNationsConventiononthe
EliminationofAllFormsofDiscriminationagainstWomen(Cedaw)hadtheforceoflawin
Malaysiaasthecountryhadaccededtothehumanrightstreatyin1995.
TansaidthegovernmentappealedagainsttheHighCourtdecisionbutwithdrewitatthe
lastminute.TheCourtofAppealthenorderedRM5,000incosts.
ThelawyeralsonotedthatwhileNoorfadillahadwonhercaseagainstthegovernment,
Malaysiancourtsrefusetoholdprivateactorslikecompaniesliableforbreachof
constitutionalrights,referringtotheBeatriceFernandezcaseinwhichaformerMalaysia
Airlinesflightstewardesssuedtheairlinewhenitfiredheraftershebecamepregnantand
refusedtoresign.
Todate,thecourtsarefollowingthedecisioninBeatriceFernandezthatheldthatcitizens
canonlybringaclaimforbreachofconstitutionalrightsifthepartydoingthe
discriminationisapublicauthority,saidTan.
Inthisrespect,Malaysiaisfailinginitsduediligencedutytoensurethatprivateactorsbe
punished,andtoenableclaimantstobecompensatedforsuchbreaches,sheadded.
In2005,theFederalCourtupheldtheCourtofAppealsdecisionintheBeatrice
FernandezcasethattheFederalConstitutionprotectedonesfundamentalrightsfrom
beingviolatedonlybythestate.
