Recomendation

There are no recommendations for remedying the abandoned Highland Towers building due to safety factors. This document provides recommendations that should have been followed during construction to prevent collapse: 1) Erosion effects should have been considered when clearing land and retaining walls should have been stronger and deeper to prevent land shifting. 2) Architects, engineers, and developers had a duty of care to ensure foundations could withstand lateral loads, slopes were stable, and retaining walls and drainage were sufficient before further construction. 3) Increasing water flow and removing trees could foreseeably erode soil and silt that could damage downstream areas. Artificial barriers should not have redirected natural water flow.

Recommendation for Remedies

There is no recommendation for remedies for highland tower because the building is left for
abandoning due to safety factors. This is the recommendation of precaution should be taken before
and during the construction of the highland tower to avoid the collapsed:
Firstly, the effects of erosion should be considered when clearing a plot of land.
Secondly, the retaining walls should be designed to be stronger as well as go deeper in the
ground to further prevent large masses of land shifting). In Malaysia, where there are times
of the year with constant downpour, it is difficult to design for such catastrophes. In this
case, it seemed that all the necessary precautions had been taken to prevent such a tragedy.
The architect should not breach his duty of care to the plaintiffs. He must foresee that the
apartments he built would be sold, and purchasers, their servants and/or agents would be
occupying them
The engineer should have exercised care to either design and construct a foundation to
accommodate lateral load or ensure that the slope was reasonably stable
The developer should not breach his duty of care to the plaintiffs. They must have
reasonably foreseen that such works, if insufficient and ineffective, would cause the
collapse of Block 1 and result in damages to the plaintiffs, who were its neighbours under
the principle of negligence. Moreover, the developer also should maintain the retaining
walls and the drainage system and proved to be sufficient and adequate before proceeding
to the next stage of construction.
As property developer and/or manager of development projects on a hill. They should
know that by diverting watercourses on their land to the east stream, they would increase
the volume of discharge to this outlet. With an extensive area of their land denuded of trees,
they must have foreseen that water flowing over this area would carry with it eroded soil
and silt which would be deposited downstream.
The artificially erected barriers should not be being used on their land to redirect its natural
flow path into the east stream which consequently caused the damage suffered by the
plaintiffs
