Sometime in March 2007, accused Goria was hired by plaintiff as stay-in caretaker of his business
at Binondo, because of his generosity, plaintiff also allowed accused Nike to live with his wife at the
plaintiffs house even though is not employed by the plaintiff in any capacity.
Several months after, Mr. Dela Cruz noticed that he has been missing some valuables inside his
house. He did not bother at first because they are of small value only. Then on October 28, 2007 he was
informed by Pedel B. Damot, his gardener, that he saw Goria and Nike inside his (Juan) bedroom and
hurriedly left the house thereafter. He (Juan), then, proceeded to his room and noticed that his jewelries
were missing along with his attach case full of cash.
Armed with his .45 caliber pistol, they looked for the spouses. They caught them in Park n Ride
Terminal at Plaza Lawton queuing for a bus bound for Batangas. In their possession was the attach case
of Mr. Dela Cruz and his jewelry.
The spouses were arrested, then and there, by the police officers stationed at the said bus
terminal.
