APPLICATION FOR APPOINTMENT OF LOCAL COMMISSION UNDER


SECTION 75 READ WITH ORDER 26 RULE 9 OF THE CIVIL
PROCEDURE CODE, 1908 ALONG WITH ALL OTHER ENABLING
PROVISIONS OF LAW

Respectfully Submitted

1. That the captioned suit is pending adjudication before this Honble


Court and is now fixed on 08.09.2017.
2. That the brief facts of the case are that the applicant/ Plaintiff is
the owner and Possession holder of Property 3 Kanal and 10
Marala (70 Marla only) situated Mouza Jungle Rang Ali Tehsil
Sadar District Multan vide Jamabandi 2007-2008 of the
description Khewat Number 24/24, Khatauni Numbers 118 to 128,
from Total Land in Khata 150 Kanal and 15 Marla. Fresh Copy of
Fard Malkiat in favor of the applicant taken from Computerized
center is now also attached with this application

3. That the applicant is in exclusive possession of the subject land


after the purchase of the land strictly in accordance with the details
contained in Fard Malkiat dated January 5 th, 2011, however the
respondents are forcibly disputing this fact in order to maneuver
the situation in their favor.

4. That the reason necessitating the filing of the instant Application is


that to bring clear picture before this Hon ble court as to whom
land is actually under possession.

5. That in addition to what has been stated above, without


determining the present possession of the land this Hon ble Court
is unable to resolve the real controversy between the parties.

6. That the Applicant seeks this Hon ble Courts indulgence for
appointment of local commission so as to determine the present
possession of land in order to reveal the truth.
7. That the applicant is ready to bear the cost for the requisite
purpose.

PRAYER

Under the circumstances, it is most respectfully prayed that


the local commission may graciously be appointed for the purpose
of determining the present possession of land.

Any other relief which this honorable Court deems fit may also be
granted.
