Revised Spectrum Charges For GSM and CDMA

The Government of India's Ministry of Communications & IT revised the spectrum charges for CDMA and GSM access networks provided by telecom service providers. The revised rates, which come into effect on April 1, 2010, range from 3-8% of Adjusted Gross Revenue depending on the amount of spectrum used by each provider. The spectrum charges cover royalty fees for spectrum usage as well as license fees for base stations and subscribers. Service providers must pay interest and penalties for any delayed payments of spectrum charges.

ORDER

Subject: Revised Spectrum Charges for CDMA & GSM access networks of
Telecom Service Providers -reg

In pursuance of the powers conferred by Section 4 of the Indian Telegraph Act,


1885 (ACT No.13 of 1885) the Central Government hereby prescribes the following
rates of Spectrum charges for the CDMA & GSM access networks of Telecom Service
Providers. This is in supersession of earlier order No. L-14041/06/2000-NTG dated 1 st
February 2002 , partial modification of order No. L-14047/06/2004-NTG dated 15 th April,
2004 & No. J-14025/200(3)/04-NT dated 21 st April, 2004, and without prejudice to any
other order (s) of WPC / DOT in force from time to time.

2. The above revised rates shall come into force with effect from 1 st April, 2010.

3 The royalty and license fee for the use of spectrum for point-to-point and point-
to-multi point links shall be separately payable as per the rates and procedure
prescribed by WPC wing from time to time.

4 The above spectrum charges are subject to review by WPC Wing from time to
time.

5 The spectrum charges will be for complete service area (not city wise) for
wireless access system and will include royalty for spectrum as well as license fee for
base stations and subscriber’s terminal. The service providers will be liable to pay
interest and penalty for delayed payments as per existing orders on the subject.

6. This issues with the concurrence of Sr. DDG (WPF) vide Dy. No. 164 dated 25 th
February 2010.
