1. “It is not the dominant position but its abuse that is prohibited under the Competition
Law.” In the light of the above statement discuss the provisions of the Competition
Act, 2002 relating to abuse of dominant position.
2. Discuss the provisions of the Companies Act, 2013 as enshrined in Section 235
relating to takeover of a Company by acquisition of its shares. Also enumerate the
rights of shareholders dissenting to the scheme of acquisition.
3. Discuss in detail the provisions of the Company Act, 2013 relating to revival
andrehabilitation of Sick Companies.
4. ‘The modern approach is shifted from that of conservation of foreign exchange to one
offacilitating trade and payments as well as developing orderly foreign exchange
market”. Critically evaluate this statement.

1. What do you mean by right of redemption, equity of redemption and clog on
redemption? Discuss the doctrine “Once a mortgage always a mortgage”, with the
help of the relevant case law.
2. Define easement. Describe the various modes of creation and extinction of easement
with the help of factual examples and leading case law.
3. “A licence does not create any interest in the immovable property of another but a
bare permission to use.” Critically analyse this statement. Also draw the clear
distinctions between lease and licence.
4. What is charge? Differentiate charge with simple mortgage. Do you agree that every
mortgage there is charge but every charge is not mortgage, if so, why?
5. Discuss under what conditions a gift can be revoked or suspended.
A gift deed of a house worth of Rs 20 lakh executed by a lady M, aged about 62 years,
in favour of a lady L, aged about 27 years, on the conditions that she will marry with
V, the son of M, aged about 32 years and will live with them and also to take care of
them. Accordingly L married with V and started living with them. Unfortunately, V
died in a road accident just after one year of the marriage. Thereafter, M started
torturing L which compelled her to leave the house and returned to her maternal
home. Now, M has entered into an agreement of sale of gifted property with K but L
has claimed the gifted property. Decide the case by referring relevant statutory
provisions and case laws.

completion of the sale of an immovable property.
