Joinder Diagrams

1) A defendant must assert as a counterclaim any claim arising from the same transaction or occurrence as the original lawsuit or it will be precluded. 2) A third party defendant must assert any defenses against the plaintiff and any compulsory counterclaims; they may also assert permissive counterclaims or crossclaims. 3) A defendant's permissive counterclaim does not need to arise from the same transaction or occurrence but requires independent jurisdiction.
