Pavicic - South Jordan Police Department, Agency Case No. 18F018652, upon a written declaration states on information and belief that the defendant, BOBBI LEIGH PHILLIPS, committed the crime(s) of: COUNT 1 DRIVING UNDER THE INFLUENCE OF ALCOHOL AND/OR DRUGS, 41-6a-502 UCA, a ‘Third Degree Felony, as follows: That on or about December 30, 2018 at 835 West 11400 South, in Salt Lake County, State of Utah, the defendant did operate or was in actual physical control of a vehicle, and (1)@) had sufficient alcohol in the defendant's body that a subsequent chemical test showed that the defendant had a blood or breath alcohol concentration of .08 grams or greater at the time of the test; STATE vs BOBBI LEIGH PHILLIPS DAO # 19000172 Page 2 (b) was under the influence of alcohol, any drug, or the combined influence of alcohol and any ‘drug to a degree which rendered the defendant incapable of safely operating a vehicle; (©) had a blood or breath alcohol concentration of .08 grams or greater at the time of operation or actual physical control; and (2)(@) inflicted serious bodily injury upon another as a proximate result of having operated the vehicle in a negligent manner; (b) had two or more prior convictions as defined in Subsection 41-6a-501(2), each of which was within ten years of: (j) the current conviction under Section 41-6a-502; or (i) the commission of the offense upon which the current conviction is based; or (©) a conviction under Section 41-6a-502 will be at any time after a conviction of: ( automobile homicide under Section 76-5-207 committed after July 1, 2001; Gil) a felony violation of Section 41-6a-502 or a statute previously in effect in this state that would constitute a violation of 41-62-502 committed after July 1, 2001; or ii) any conviction described in Subsection 41-6a-502(2)(c)(i) or (ii) which judgment of conviction is reduced under Section 76-3-402. COUNT 2 POSSESSION OR USE OF A CONTROLLED SUBSTANCE, 58-37-8(2)(a)(i) UCA, a Class B Misdemeanor, as follows: That on or about December 30, 2018 at 835 West 11400 South, in Salt Lake County, State of Utah, the defendant did knowingly and intentionally possess or use an unauthorized controlled substance analog or controlled substance, to wit: COUNT 3 FAILED TO OPERATE VEHICLE ON RIGHT SIDE OF ROADWAY, 41-62-701 UCA, an Infraction, as follows: ‘That on or about December 30, 2018 at 835 West 11400 South, in Salt Lake County, State of Utah, the defendant did (a) fail to operate a vehicle on the right half of a roadway of sufficient width; or (b) fail to operate a vehicle, while proceeding at less than the normal speed of traffic, in the right- hhand lane then available for traffic or as close as practicable to the right-hand curb or edge of the roadway. THIS INFORMATION IS BASED ON EVIDENCE OBTAINED FROM THE FOLLOWING WITNESSES: Officer G. Pavicic and Madison McCurdy. STATE vs BOBBI LEIGH PHILLIPS DAO # 19000172 Page 3 DECLARATION OF PROBABLE CAUSE: ‘Your declarant bases this Information on the following: The report of South Jordan Police Officer Gary Pavicic that on December 30, 2018 at about 00:51 am, he responded to a vehicle collision in the area of 834 West 111400 South. Upon arrival, Officer Pavicic approached a 2006 Land Rover and identified the driver as BOBBI LEIGH PHILLIPS, who was seated in the driver seat. Officer Pavicic noted that the side airbags had deployed and that there was a strong odor of alcohol in the vehicle. Pavicic noted a strong odor of alcohol coming from PHILLIPS when she was in the vehicle as well as later when she was out of the vehicle. PHILLIPS stated that was driving “this way” (pointing east) and that the other vehicle “came from the right”. While speaking with PHILLIPS, Pavicic noted that her explanation of where she was going seemed mixed up, her speech was slow and lethargic and she had red, blood-shot eyes and hher balance was occasionally poor. Pavicic had PHILLIPS perform the horizontal gaze nystagmus test and noted six out of six clues indicating intoxication as well as two on the vertical gaze nystagmus test. PHILLIPS also repeatedly moved her head despite instructions not to do 50. Pavicic took PHILLIPS to the police station to take an Intoxilizer test. Pavicic observed Baker and read PHILLIPS Miranda warnings. PHILLIPS blew two successive insufficient samples despite repeated instructions on how to blow. The two insufficient samples showed .186 and .232 BAC, respectively. ‘The report of Draper Police Officer R. Barlow that a search of PHILLIPS’ vehicle subsequent to a positive drug dog indication revealed 7.8 grams of field-tested positive Marijuana. ‘The report of Draper City Police Officer B. Ehlert that PHILLIPS was driving the 2006 grey Land Rover Range Rover and Sonya Wilson was driving blue 1990 Toyota Corolla, that were involved in the collision. Wilson was extricated from her vehicle by fire rescuers and transported via ambulance to the Intermountain Medical Center. The statement of Kyle Stamp, that he witnessed the collision and saw a silver Range Rover (SUV) with a female driver come down the wrong side of the road in the fast lane and collide with a Toyota moving in the correct direction, also being driven by a female. He states that after the collision it seemed like the Range Rover was trying to leave the scene. ‘The written statement of Sonya Wilson, the driver of the Toyota Corolla, that she was on 11400 south heading eastbound, in the eastbound lane, when she saw headlights and then was stuck in her car and was not able to move her legs.
