This affidavit provides 3 reasons for desisting from a criminal complaint: 1) The complaining witness has established residence in another city and it is uncertain when they will return. 2) The whereabouts of witnesses in the case are unknown as they have moved with no contact. 3) Pursuing the case would be extremely difficult for the complaining witness due to having to travel back and forth for court appearances and locate witnesses. The affidavit requests that the complaint and information be withdrawn and deemed not filed.

I, _______________, of legal age, single, and a resident of _______________,


after having duly sworn to in accordance with law hereby depose and state:

1. That I am the complaining witness for


________________________________ against
________________________ in __________________;

2. That I will be leaving Iloilo City since I already established my residence in


Metro Manila and it cannot be determined if when will I return;

3. That I cannot determine the whereabouts of my witnesses in the case since


they already transferred residence and I lost contact with them;

4. That the I have decided not to pursue the case against the accused
considering that under the circumstances, it will be extremely difficult for me
to go back and forth to attend to this case and know the whereabouts of my
witnesses;

5. That in view of the fact that the I will no longer pursue the said complaint
against the respondent, the complainant most respectfully prays that herein
complaint and information be withdrawn and deemed not filed;
