WHAT ARE THE PARTS OF A CASE?

INTRODUCTION TO LAW

Basically the parts of the case are as follows:

1. Facts

2. Issues

3. Ratio Decidendi/Decision/Held

Facts can speak for themselves. It is the facts of the case, which determine the
issues raised by the parties as well as the decision to be rendered by the court.
In a nutshell, it is the story told by the parties. This is comprised of the persons,
time, place, and other information considered by the court.

Issues, on the other hand, are the issues raised by one or both parties. It is
predominantly what the court will try to answer or settle.

The ratio decidendi is where the decision of the court lies. It is the basis or the
law used by the court to decide on the issue/s raised by the parties. This is
where the principles and general reasons are. Usually, the law applicable is
stated and how the law is applicable to the facts and issues at hand.

**the decretal or dispositive portion is the portion at the last part of the case
wherein the court renders its judgment. You will know that it is the decretal
portion when you see the word “WHEREFORE”.
