INDICTMENT

Kwaku Mawuli ADOBOLI is charged as follows:

Count 1
Statement of Offence.

False accounting, contrary to section 17(1)(a) of the Theft Act 1968.

Particulars of Offence.

Kwaku Mawuli ADOBOLI between the 1st day of October 2008 and 1st day of June
2011 dishonestly, with a view to gain for himself or another or with intent to cause
loss to another, falsified a record or records in relation to an Exchange Traded Fund
transaction, or transactions and/or other internal records of the UBS Bank, made or
required for an accounting purpose in order to conceal the exposure of UBS to risk
and / or the true profit and loss.

Count 2
Statement of Offence.

False accounting, contrary to section 17(1)(a) of the Theft Act 1968.

Particulars of Offence.

Kwaku Mawuli ADOBOLI between the 1st day of October 2008 and 1st day of June
2011, other than in Count1, dishonestly, with a view to gain for himself or another or
with intent to cause loss to another, falsified a record or records in relation to an
Exchange Traded Fund transaction, or transactions and/or other internal records of
the UBS Bank, made or required for an accounting purpose, namely entering and / or
holding a zero notional / cash only trade or trades in order to conceal profit or loss.

Statement of Offence.

Fraud by abuse of position, contrary to Sections 1 and 4 of the Fraud Act 2006.

Particulars of Offence.

Kwaku Mawuli ADOBOLI between the 1st day of October 2008 and the 1st day of
June 2011 committed fraud in that, while occupying a position of trust namely that of
a senior trader with Global Synthetic Equities (or its previous equivalent known as
Cash Equities) in which he was expected to safeguard or not to act against the
financial interests of UBS Bank, he dishonestly abused that position by causing or
exposing UBS Bank to losses intending thereby to make a gain for himself, or cause
losses to UBS Bank or to expose the bank to risk of loss, in breach of section 4 of the
Fraud Act 2006.

Count 4.
Statement of Offence.

False accounting, contrary to section 17(1)(a) of the Theft Act 1968.

Particulars of Offence.

Kwaku Mawuli ADOBOLI between the 31st day of May 2011 and the 15th day of
September 2011 dishonestly, with a view to gain for himself or another or with intent
to cause loss to another, falsified a record or records in relation an Exchange Traded
Fund transaction, or transactions and/or other internal records of the UBS Bank made
or required for an accounting purpose in order to conceal the exposure of UBS to risk
and / or the true profit and loss.

Count 5
Statement of Offence.

False accounting, contrary to section 17(1)(a) of the Theft Act 1968.

Particulars of Offence.

Kwaku Mawuli ADOBOLI between the 31st day of May 2011 and the 15th day of
September 2011, other than in Count 4, dishonestly, with a view to gain for himself
or another or with intent to cause loss to another, falsified a record or records in
relation to an Exchange Traded Fund transaction, or transactions and/or other internal
records of the UBS Bank, made or required for an accounting purpose namely
entering and / or holding a zero notional /cash only trade or trades in order to conceal
profit or loss.
Count 6.
Statement of Offence.

Fraud by abuse of position, contrary to Sections 1 and 4 of the Fraud Act 2006.

Particulars of Offence.

Kwaku Mawuli ADOBOLI between the 31st day of May 2011 and the 17th day of
September 2011 committed fraud in that, while occupying a position of trust namely
that of a senior trader with Global Synthetic Equities in which he was expected to
safeguard or not to act against the financial interests of UBS Bank, he dishonestly
abused that position by causing losses to UBS Bank calculated at $2.2502 billion US
dollars intending thereby to make a gain for himself, or cause losses to UBS Bank or
to expose the bank to risk of loss, in breach of section 4 of the Fraud Act 2006.
