CONTRACT OF EMPLOYMENT

(For Household Workers)

KNOW ALL MEN BY THESE PRESENTS:

This EMPLOYMENT CONTRACT is executed and entered and into by between:

Voluntarily binding themselves to the following terms and conditions:

1. PLACE OF EMPLOYMENT: ______________________________________________________.

2. HOURS OF WORK: 8 hours per day


2.1 Work in excess of 8 hours shall entitle the WORKER to overtime pay. Work performed during rest
days and legal holidays shall entitle him/her to premium pay in accordance with the law of the place
of employment.
2.2 WORKER shall be entitled to paid vacation leave of ______ days per year. Such holidays shall be
enjoyed at a time mutually agreed upon by the EMPLOYER and the WORKER

3. DUTIES OF THE WORKER:


3.1 To work diligently as a domestic WORKER for the duration of his/her engagement.
3.2 To reside at the residence of the EMPLOYER, or upon arrangement in case of Live-Out, be at the
place of work on time to perform the formal duties of which he/she has been engaged such as cooking,
cleaning, house and yard cleaning, and other household chores.
3.3 Not to receive any visitor at the workplace without prior knowledge and consent of the EMPLOYER.
Likewise, WORKER shall not leave his/ her place of work without the permission of the
EMPLOYER.
3.4 To ask permission or make arrangement with EMPLOYER on the use of Telephones and Internet.

4. DUTIES OF THE EMPLOYER:


4.1 To register the WORKER and remit the necessary premiums or contributions with the Social Security
System (SSS), Philippine Health Insurance Corporation (PhilHealth), and Home Development Mutual
Fund (HDMF/Pag-IBIG).
4.2 To treat the WORKER in a just and humane manner
4.3 To issue corresponding Pay slip during Payday and to assist in the opening up of a personal Bank
Account.
4.4 To ensure that the WORKER receives such benefits enjoyed by other workers in a comparable
employment.
4.5 To assist the workers in the acquisition of proper identification, such as Social Security Number
ID/Card and other necessary Identification Cards.

4. DURATION OF EMPLOYMENT: From ________ until __________


5. WAGES: Monthly basic salary shall be _____________ based on 8 hours a day work, 40 hours per week; to
be paid on the 15th and the 30th of each work month. WORKER shall be paid ______ per additional hour of
overtime work.

WORKER consents to the deduction of his/her monthly basic salary for the payment of employee’s
contribution in SSS, PhilHealth, and HDMF/Pag-IBIG.

6. REST DAYS, VACATION LEAVE, and BENEFITS:


6.1 Work in excess of 8 hours shall entitle the WORKER to overtime pay. Work performed
during rest days and legal holidays shall entitle him/her to premium pay in accordance with
the law of the place of employment.
6.2 WORKER shall be entitled to a rest day every ___________________.
6.3 The EMPLOYER may NOT require the WORKER to remain at the EMPLOYER’S home or at the
place of employment during his/her free time. WORKER can leave the workplace when he/ she are
off from work.
6.4 WORKER shall be entitled to five (5) days of paid leaves per year.
6.5 WORKER shall be entitled to free first-aid assistance in case of sickness.

7. TERMINATION OF CONTRACT:

EMPLOYER may terminate this contract WITHOUT CAUSE by serving a written notice to the EMPLOYER
at least fifteen (15) days in advance. WORKER shall be entitled to compensation of fifteen (15) days’ worth
of basic pay in case of termination without cause.
