ADDENDUM TO REAL ESTATE PURCHASE AND SALE AGREEMENT

The undersigned parties to a Purchase and Sale Agreement dated _____________________,


by and between DELBERT M. ALMONIÑA, of legal age, Filipino citizen, married and
resident of No. 4 Payte St. Masambong, Quezon City (“Purchaser”), and IMELDA A.
ESTALLO, of legal age, Filipino citizen, married and resident of No. 4 Payte St. Masambong,
Quezon City (“Seller”), for the purchase and sale of that certain property municipality
known as

A parcel of land (Lot 4, Block 437 of the subdivision plan (LRC) Psd-3743, being a
portion of Block 429, described on plan Psd-46398, LRC (GLRO) Recorded No. 7681)
situated in Quezon City, Island of Luzon bounded on the NE., points 3 to 4 by Lot 6, Block
437; on the SE., points 4 to 1 by Lot 3, Block 437; on the SW., points 1 to 2 , Block 437;; and
on the NW., point marked “1” on plan being N.47 deg. 57, 2565.94 m. from C.B.M 37, Manila
Cadastre, thence 3/7 deg. 38’E., 17.00 m to point 4; thence S. 32 deg. 22”W., 12.00 m. to the
point of beginning an area of TWO HUNDRED FOUR (204) SQUARE METER, more or less.
All points referred to are indicated on the plan and are marked on the ground by PLS. Cyl.
Conc. Mons.; bearing true, declination 0 deg. 45’E.; date of the original survey, Dec 1910-
June 1911 and that of the subdivision survey, Dec 3, 1952- Dec 6, 1956.

(“Property”), hereby mutually agree to amend said Agreement as follows:

That the SELLER has acquired ownership over 1/10 portion (hereinafter called Subject
Lot) of the above-described real estate property by virtue of an Extrajudicial Partition of
Property (copy attached) executed by their parents late ILUMINADA C. ALMONIÑA and
late ARMANDO M. ALMONIÑA of the registered owner thereof and their surviving
children, namely, (1) MELITON C. ALMONIÑA married to PATRICIA ALEJO, (2) ALBERTO
C. ALMONIÑA, single, (3) JUAN C. ALMONIÑA, single (4) REGALADO C. ALMONIÑA,
married to LAARNI SACOPLA, (5) RODOLFO C. ALMONIÑA, married to EVA SARMIENTO
(Deceased), (6) ROGELIO C. ALMONIÑA, married to AGUSTINA LENE MUÑOZ, (7)
RONALDO C. ALMONIÑA, married to RUBY RIVERA, (8) IMELDA C. ALMONIÑA, married
to ZOSIMO ESTALLO, and their children namely, ARNON REY ALMONIÑA, ARNILOU
ALMONIÑA, ANA LOURAINE ALMONIÑA, AARON RED ALMONIÑA, (representing their
deceased father, REYNALDO C. ALMONIÑA) and DARLING BILO, RAM BILO and MARGE
BILO (representing their deceased mother, GLORIA C. ALMONIÑA, married to MARIO
BILO).

That the SELLER has offered to sell, and the BUYER has agreed to buy, the SUBJECT LOT,
with an area of 20.4 SQUARE METER, on which the latter’s house stand;
That the SELLER warrants that the Subject Lot is free from any lien or encumbrance and
shall defend its ownership and title over the same;

It is hereby understood that the capital gains tax, documentary stamp tax, transfer tax, and
such other taxes or fees as are necessary for the registration of the Subject Lot in the name
of the BUYER, shall be for the account of the BUYER;

It is also understood that the SELLER, upon demand by the BUYER, shall execute the DEED
OF ABSOLUTE SALE over the Subject Lot in favor of the BUYER once the latter has
determined that all the documents, which are necessary for the transfer of title over the
Subject Lot in favor of the BUYER, have been prepared;

That the SELLER has received ₱150,000.00 Pesos in Philippine Currency, the receipt of
which is hereby sells/cedes/transfers to the BUYER all his right and interests over the
Subject Lot.

All other terms and conditions of the Sales Contract to remain the same.
