THIS AGREEMENT OF LEASE executed at Bangalore this 28th day of June 2019
BETWEEN Mrs. Anuradha Gupta, D/o. Mr Suresh Chandra Gupta, aged about 40 years
having PAN number AIIPG6875F (hereinafter called the LESSOR which expression
shall, wherever the context permits, mean and include her legal heirs and their legal
representatives) of the One part.

(Hereinafter referred to collectively as “THE LESSEE(s)” which expression shall mean and
include its successors in interest and assigns) of the OTHER PART.
WHEREAS
The LESSOR are the absolute owner of the flat B 1702 Brigade Metropolis Whitefield
Rd Bangalore 560048, and more particularly described in the schedule hereunder and
hereinafter called the Schedule Property.
The LESSOR, at the request of the LESSEES, hereby leases the Schedule Property
along with the fixtures and fittings as attached in Annexure A, to the LESSEES for a
period of 11 months commencing from July 1st, 2019 to 31st May, 2020, renewable for
further period/s of Two terms of 11 months each on the following mutually agreed terms
and conditions:
LESSEE’S COVENANT
SECURITY DEPOSIT
i. The LESSEE has placed with the LESSOR by way of interest free refundable
Security Deposit, an amount of.Rs 3,00,000/- (Rupees Three Lakh only) vide
● Rs. 200,000/- RTGS dated drawn on __________Bank dated________
● Rs. 100,000/- RTGS dated drawn on __________Bank dated________
ii. The LESSOR agrees to fully refund the Security Deposit placed with her by the
LESSEE on termination of this Lease Deed and on delivery of vacant
possession of the Schedule Property by the LESSEE, when the LESSEE vacates the
premises and hands over vacant possession of the Schedule Property, subject to
deduction of any arrears of rent / electricity/water bills if remaining unpaid or
amounts towards actual, independently verified damage to the said property caused
by the Lessee, if any, fair wear and tear excepted.
UTILITIES
i. The LESSEES shall pay for consumption of Electricity/GAS for the premises
occupied by the LESSEES directly to the concerned authorities as per the monthly
bills received. The LESSEES shall pay the monthly charges towards usage of the
club house facilities directly to the concerned authorities. The LESSEES shall pay the
PMOA charges directly to the concerned authorities.
i. The LESSEE shall use the Schedule Property for residential purposes only and
will not alter, modify or carryout any kind of change in the Schedule Property and in
the area belonging to the Builder and or Owners’ Association. The LESSEES shall
abide by the rules and regulations of the Builder and or/Owners’ Association,
stipulated for the maintenance of the Schedule Property.
ii. The LESSEE shall properly use, operate and safeguard the Schedule Property
including fixtures, fittings and all mechanical, electrical and plumbing fixtures. The
LESSEE shall pay for all the repairs or replacements caused by negligence by the
LESSEE.
ASSIGNMENT
i. The LESSEE shall not assign or sub-let, lien, mortgage or otherwise part with
possession of the Schedule Property to anybody under any circumstances. The
i. The LESSEE will not any internal partitions, fixtures, fittings from the
premises. LESSEE will not damage the premises and existing
structures and at the time of vacating/handing over to the LESSOR, in
the original condition.
TERMINATION
i. The Lease can be terminated at the option of either party by giving the other
party one month’s notice (notifying on the 1st day of the month) in advance prior to
the expiry of this agreement, in writing, to the effect. If the LESSEES notify the
LESSOR after 1st day of the month, this month and the following month will be
considered as the notice period. Upon termination/moving out, the LESSEES agree to
pay cost of painting charges and clean up the scheduled property before handing over
possession and collecting the security deposit placed with the LESSOR as per clause
2(iii)
ii. During the notice period the LESSEE agree to co-operate and allow prospective
tenants to view the scheduled property, after firming up a convenient time with the
LESSOR’s Agent or Representative.
iii. If anyone of the LESSEEs decides to leave the house and during the notice period,
the vacancy is filled by another LESSEE. The new LESSEE is supposed to provide
the security deposit to the LESSOR and the LESSOR is supposed to be returning the
security deposit of it’s previous LESSEE worth 1 lakh rupees so that LESSOR has
their security deposit intact as well as LESSE gets his/her initial amount paid as
deposit.
3. The LESSOR covenants with the LESSEE as follows:
REPAIRS
i. The LESSEE on their inspection has been satisfied about the premises wind and
water tight and in good and substantial repair and condition for their use. The
LESSEE shall be responsible to carry out all minor maintenances such as fused
Bulbs, leakage of water taps at their own cost and the major repairs such as
structural, roof leakage, major plumbing line breakage/leakage, unless caused
by omissions and commissions of the LESSEE shall be attended by the
LESSOR.
i. The LESSOR shall pay all rates, taxes, ground rent, land revenue, cesses,
Assessments and other outgoings whatsoever imposed or payable in respect of the
Schedule Property.
4. GENERAL:
i. On the LESSEE paying the rent herein reserved, and observing other covenants
herein stipulated, the LESSOR shall permit the LESSEE to hold and enjoy the
Schedule Property during the terms of lease herein stipulated or such extended
periods as agreed to without any interruption by the LESSOR or her servants,
workmen, agents, or any person claiming through or under, or in trust for the
LESSOR.
ii. To permit the LESSEE, their servants and visitors at all times
during the subsistence of this lease to use in common with the LESSOR and other
tenants or occupiers of the building of which the Schedule Property forms part,
entrances, doorways, staircases, landings, lobbies, paths and passages leading to and
from the Schedule Property for the ingress and egress.
iii.The LESSOR shall at all times during the subsistence of this lease, have the
right to inspect the Schedule Property after giving adequate notice of such
inspection in writing to the LESSEES.
iv . Non payment of rent or if the rents are in arrears for over two months, the same
shall be deemed as a reasonable cause for termination of this Lease Agreement and
the amount due will be deducted from the Security Deposit held by the LESSOR.
vi. If at any time, the said premises is rendered partially or wholly uninhabitable or
unfit for residing due to fire (not due to the negligence of those occupying the house
as per the LESSEE knowledge and agreement), or any other accident or acts of
God or acts of state, the LESSEE shall, not withstanding anything hereinbefore
contained, have the option to vacate the said premises and the terms and conditions
herein contained shall remain in abeyance until the said premises is made habitable
by the LESSOR for re-occupation by the LESSEES of the Schedule Property, the
LESSEES shall not be liable to pay compensation or other charges during the
period of the said premises being not used by the LESSEES for the reasons
aforesaid.
4. RENEWAL
The Lease may be renewed for a further period/s of Eleven months by mutual
consent of the LESSOR and the LESSEES. The monthly rent upon renewal shall be
at a 5% increase in the current rent.
6. This Agreement represents the entire agreement between the parties hereto on the
subject matter hereof and cancels and supersedes all prior agreements, arrangements
or understandings, if any, whether oral or in writing, between the parties hereto on the
subject matter hereof. In the event of any disputes, both parties agree that the courts
of Bangalore shall be the place of jurisdiction.
7. This Agreement is executed in two counter parts each of which shall be deemed an
original, but all of which together shall constitute one and the same instrument. One
shall be retained by the LESSOR and the other by the LESSEE.
SCHEDULE PROPERTY
All that the entirety of the Apartment being B 1702 Brigade Metropolis Whitefield
Road Mahadevpura 560 048, having an approximate area of 1610 sq.ft consisting one
living cum dining room, kitchen with a utility area, three bedrooms with attached
bathrooms, three balconies. The fittings and fixtures are as per the Annexure.
IN WITNESS WHEREOF the parties hereto have set their hands on the day, month
and the year first above written.
