BHRN-CSO MEMORANDUM OF AGREEMENT

This MEMORANDUM OF AGREEMENT (the “Agreement”) made and executed this 16 th


day of July , 2019 at the EM Manor Hotel and Convention Center, Cotabato City, Bangsamoro
Autonomous Region of Muslim Mindanao (BARMM), by and between Civil Society Organizations
in the Bangsamoro Autonomous Region in Muslim Mindanao, collectively referred to herein as
Parties to this Agreement.

WITNESSETH: THAT –

WHEREAS, Article II, Section 23 of the 1987 Philippine Constitution declares that he State
shall encourage non-governmental, community-based, or sectoral organizations that promote the
general welfare of the nation

WHEREAS, Article Il, Section 11 of the 1987 Philippine Constitution declares that the
State values the dignity of every human person and guarantees full respect for human rights

WHEREAS, Civil Society Organizations play an important role in enhancing public


participation in the delivery of services and in policy decision making

WHEREAS, Parties to this agreement represent organizations in the Bangsamoro


Autonomous Region In Muslim Mindanao (BARMM) with juridical personalities granted under
Philippine law;

WHEREAS, Parties to this agreement bonded together in words, spirit and deeds under
a common goal of advancing the cause of promotion and protection of the human rights of the
Bangsamoro people within and outside the Bangsamoro Autonomous Region of Muslim
Mindanao .
WHEREAS, Parties to this agreement recognize the need to work together further as
independent yet united entities towards effective and meaningful human rights advocacy for our
common aspirations;

WHEREAS, Parties to this agreement are cognizant of the important role human rights
advocacy has in fulfilling the aspirations of the Bangsamoro people to attain self -sufficiency and
progress under a regime governed by cherished human rights principles;

WHEREAS, Parties to this agreement are aware that in Bangsamoro history,the protection
of Bangsamoro rights and the provision of basic necessities for the Bangsamoro people are
enshrined as pillars of the Bangsamoro moral and good governance goals;

WHEREAS, Parties to this agreement are ready to take on various responsibilities under
varying levels of effort as provided in the hereunto accompanying Governance and Human Righst
Monitoring guidelines document which will serve as a guide for the advancementof the cause of
human rights protection and promotion in the Bangsamoro Autonomous Region of Muslim
Mindanao; and

WHEREAS Parties to this agreement accept, by way of establishing the working


mechanism with the Regional Human Rights Commission having governmental and corporate
personlaity, its successors and assigns, as the convenor and coordinator in the work of human
rights protection and promotion in the Bangsamoro Autonomous Region of Muslim Mindanao;

NOW, THEREFORE, for and in consideration of the foregoing premises, the parties to this
agreement have agreed as follows:

1) To declare that,heretofore, all signatories herein shall be referred to as BHRN-


CSO members;

2) To declare that this agreement covers common human rights promotion and
protection work under the convenorship of the Regional Human Rights
Commission, BARMM, and other activities undertaken for and in behalf of our
loose aggrupation,to be known as the “Bangsamoro Human Rights Network-Civil
Society Wing” hereinafter referred to as “BHRN-CSO”;

3) To declare that as parties signatories herein, we recognize the Regional Human


Rights Commission, Bangsamoro Autonomous Region of Muslim Mindanao,

hereinafter referred to as RHRC-BARMM its successors and assigns, as the
convenor, coordinator and de facto secretariat of BHRN-CSO;

4) To declare that RHRC-BARMM, its successors and assigns may represent the
BHRN-CSO in any and all fora in and out of the Philippines relating to Human
Rights promotion and protection work;;

5) To plan together as BHRN-CSO and implement such plans as independent but


united organizations convened by the RHRC-BARMM on ways and means with
which to advance the cause of human rights promotion and protection in the
Bangsamoro Autonomous Region of Muslim Mindanao;

6) As parties signatories hereto, to act as force multipliers to the RHRC-BARMM, its


successors and assigns in order to ensure that the task of human rights violations
monitoring and reporting will continue through the transition period to the BARMM
and beyond;

7) To be guided in all our actions by the hereunto appended Governance and Human
Rights monitoring guidelines which will be implemented by the Regional Human
Rights Commission, its successors and assigns;

8) To undertake to commit, participate and independently work to implement at least


one (1) of the BHRN-CSOs declared services as provided for in the hereunto
appended Governance and Monitoring Guidelines Document; and

9) To be entitled to benefits of capacity/institutional development and such other


benefits and support as may be opportune from time to time under the
convenorship of the RHRC-BARMM, its successors and assigns;

10) The RHRC_BARMM , its successor and assigns, by appending the siganture ofits
authorized signatory herein , agrees to be bound by the herein provisions;

CIVIL SOCIETY ORGANIZATIONS (CSOS)


Non-State, not-for-profit, voluntary entities formed by people in the social sphere that are
separate from the State and the market. CSOs represent a wide range of interests and ties.
They can include community-based organizations as well as non-governmental organizations
(NGOs). In the context of the UN Guiding Principles Reporting Framework, CSOs do not include
business or for-profit associations.
