MEMORANDUM

TO : ANTONIO BALINO JR.

RE : NOTICE TO EXPLAIN

DATE : AUGUST 27, 2019

This is in reference to your alleged violation of the company policy, specifically: (a)
Gross and habitual neglect by the employee of his duties, particularly item 52,
gross and/or habitual negligence or blatant disregard to perform the care or
diligence demanded amounting to wanton or reckless disregard of established
rules and regulations, and (b) Other Analogous Cases – under Article E, Section
78, of the Company’s House Rules, respectively.

The factual antecedents of the alleged violations are as follows:

1. Pioneer Adhesive account – Despite usual reminder on the


monitoring of on-time issuance of salary for one of your
assigned employee at said account, still not able to perform
proper monitoring and a customer complaint has been
received by the undersigned dated Aug. 23, 2019.

To afford you due process, you are hereby given five (5) days from receipt hereof to
submit your written explanation stating why no disciplinary action should be
taken against you regarding the above-quoted incidents. Failure on your part to do
so will constitute willful disobedience to the lawful orders of the employer
(Insubordination) and shall be construed as a waiver of your right to be heard and
submit evidence. Thus, the company shall be constrained to resolve the case
based on available evidence.
