PARTITION AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Partition Agreement is entered into by and between the following parties:

EMMA M. CASTANEDA PATRIVO, widow, of legal age, Filipino, and a resident of


Brgy. Mandalagan, Bacolod City, Philippines, and MIGUELITO MOLANO
CASTANEDA, married to Eva Castaneda, of legal age, Filipino, hereinafter referred to
as the “FIRST PARTY” and a resident of Purok Pukatod, Sagasa, Bago City, Negros
Occidental, and herein represented by their attorney-in-fact, EVA S. NARIDA, of legal
age, married, Filipino, and a resident of Brgy. San Rafael, Miagao, Iloilo by virtue of a
Special Power of Attorney executed on April 17, 2019 under the notarial docket of Atty.
Arturo Z. Tondo, under Doc. No. 317, Page No. 64, Book 91, Series of 2019.

JUDEMA DE LOS REYES GALLO, of legal age, Filipino, married to Noel Gallo, a
resident of 2-B Osmena St., Arevalo, Iloilo City, and hereinafter referred to as the
“SECOND PARTY.”

WITNESSETH THAT:

WHEREAS, the FIRST PARTY entered into a Deed of Absolute Sale dated April 17,
2019 involving a FIVE HUNDRED FORTY NINE (549) square-meter portion of parcel of land
which they co-own. The co-owned property is more particularly described below as:

TAX DECLARATION NO. 0340

“A parcel of coconut land, known as Cadastral Lot No. 3702-pt., also designated as Assessor’s
Lot No. 68, situated at Barangay San Rafael, Municipality of Miagao, Province of Iloilo, Island of
Panay, Republic of the Philippines, consisting of ONE THOUSAND AND FORTY NINE
SQUARE METERS (1,049) sq. m., more or less. Bounded as follows: On the N., by Lot No.
3702-pt; on the S., by Lot No. 3700, Lot 3699; on the E., by Lot No. 3703 and Lot No. 3701; and
on the W., by Lot No. 3702-pt., with concrete monuments thereon.”

WHEREAS, it is to the convenience and advantage of the parties that the existing
community of ownership of the FIRST PARTY be terminated and the parties’ respective shares
and participation determined by mutual agreement and adjudication.

WHEREAS, for the purposes of this partition agreement, the parties hereto have caused
the above-described property to be subdivided into Lot Nos. 23730 and 38204 per tracing cloth
and blue print, and technical descriptions duly approved by the Land Registration Commission,
which are hereto attached, and made integral part of this agreement.

WHEREAS, the parties hereto have mutually and voluntarily agreed to partition the
parties between themselves the property in the following manner:
