Dear Ms. Miguel:

This refers to the Environmental Compliance Certificate (ECC) application for the
proposed Bissayot Resort to be located at Brgy. Comillas North, Cervantes, Ilocos Sur.

After satisfying the requirements of the said application, this Bureau has decided to grant
an ECC for the above-mentioned project.

With the issuance of this ECC, you are expected to implement the measures presented in
the Initial Environmental Examination Checklist (IEEC), intended to protect and mitigate the
project’s adverse impacts on community health, welfare and the environment. Environmental
considerations shall be incorporated in all phases and aspects of the project.

This Certificate does not create any right nor shall be used as an authorization to
implement the project, you may proceed with the implementation only after securing all
necessary permits and/or clearances required by other pertinent Government
Agencies/Offices that have administrative jurisdiction over such projects/operations (i.e.
DENR, EMB, LGU, DOT, NWRB, etc.). This Office shall be monitoring the project
periodically to ensure strict compliance with the stipulations in the attached ECC.

THIS IS TO CERTIFY THAT THE PROPONENT, MS. NOEMI MIGUEL, is


granted this Environmental Compliance Certificate (ECC), for the proposed
Bissayot Resort located in Brgy. Comillas North, Cervantes, Ilocos Sur, by the
Department of Environment and Natural Resources (DENR), through the
Environmental Management Bureau (EMB).

SUBJECT ONLY to the conditions and restrictions set in this ECC and
in the attached documents labelled as Annexes A and B.

This Certificate is issued with the following details:

PROJECT DESCRIPTION
The ECC covers the construction and operation of a 4,772 - Square
Meter Resort Project consisting of three (3) units cottage,
lobby/reception area two (2) units public washroom/toilets, five (5)
units swimming pool (2-kiddie pool, 2-adult pool & 1-natural hot
spring pool), convenient store, bar & restaurant, kayaking/boating,
fish spa, fish pool therapy, fish pond, parking area, multi-purpose
hall/admin building, gazebo and other support facilities. [Edit project

This Certificate is issued in compliance with the requirements of


Presidential Decree No. 1586 or also known as the Philippine Environmental
Impact Statement (EIS) System, and in accordance with DENR Administrative
Order (DAO) No. 2003-30. Non-compliance with any of the provisions of this
Certificate shall be a sufficient cause for the cancellation of this Certificate
and/or imposition of a fine in an amount not to exceed Fifty Thousand Pesos
(₱50, 000.00) for every violation thereof without prejudice to imposition of fines
and penalties under other environmental laws. The EMB, however, is not
precluded from reevaluating and correcting any deficiencies or errors that may
be found after issuance of this Certificate.

Annex A
I. CONDITIONS

ENVIRONMENTAL MANAGEMENT

All commitments, mitigating measures and monitoring requirements, contained


in the Initial Environmental Examination Checklist (IEEC) Report for the
Resort/Tourism Project, particularly in the Environmental Management
Plan/ Environmental Monitoring Plan, including any modifications and/or
additional information as approved by the EMB, shall be instituted to minimize
any adverse impact of the project to the environment throughout its
implementation, which shall include among others to wit:

1. Adequate and appropriate drainage system and soil erosion control


measures including other structural measures which will conform to the
natural topography shall be constructed / provided to avoid erosion and
flooding of the adjoining properties;

2. The proponent shall provide an effective Wastewater and Sewage


Treatment Facility such that wastewater effluent throughout project
implementation shall conform to the standards of water quality as per
DENR Administrative Order No. 2016-08 (Water Quality Guidelines and
General Effluent Standards of 2016) and RA 9275 (Philippine Water Act
of 2004);

3. Strictly observe standard sanitary housekeeping practices, proper


collection of solid and hazardous waste resulting from the
implementation/operation of the project shall be strictly observed. The
waste management plan shall include adequate facilities for disposal of
wastes which shall be done from the start of the construction;

4. Kitchen wastes shall be provided with a pre-treatment facility such as


grease traps and screens prior to its treatment in the primary or
secondary treatment facilities. Wastes (grease and fats) generated shall
be properly managed/handled, stored and disposed to eliminate odor
nuisance (putrefaction) and if possible utilized as organic fertilizer;

5. All applicable mitigating and enhancement measures, and proponent’s


commitments cited in the IEEC shall form an integral part of the ECC;

GENERAL CONDITIONS

6. Compliance Monitoring Report (Annex 3-1 of RPM) shall be prepared


and submitted by the Proponent/PCO to this Office semi-annually not
later than January 15 and July 15 starting from the issuance of this
certificate;

7. A Social Development Program (SDP) that will benefit the


employees/workers, host barangay and affected communities shall be
implemented, and submit a report annually as part of the CMR;

8. The project operations shall comply with the provisions of RA 8749


(Philippine Clean Air Act of 1999), RA 9003 (Ecological Solid Waste

Management Act of 2000), RA 9275 (Philippine Clean Water Act of 2004),
and RA 6969 (Toxic Substances and Hazardous and Nuclear Wastes
Control Act of 1990), to wit:
 Secure a Permit to Operate Air Pollution Source/Control
Installations & a Discharge Permit for Water Pollution
Source/Control Facilities;
 Designate a Pollution Control Officer (PCO) who shall handle the
environmental aspects of the project, and shall be duly accredited
by this Office in accordance with DAO No. 2014-02, series of 2014
(Revised Guidelines for Pollution Control Officer Accreditation)
 Submit quarterly Self-Monitoring Report (SMR) to this Office; and
 Register as a Hazardous Waste Generator

9. An ECC Billboard (3’X 5’) shall be installed at a strategic location at the


project site containing this message: “NOTICE TO THE PUBLIC, THIS
[Project Name] of [Project Proponent] has been issued an
Environmental Compliance Certificate [ECC Ref. No.] by the DENR–
Environmental Management Bureau Region 1 on [Date of Issuance];”

10. The Proponent shall notify the EMB Regional Office and submit an
abandonment mitigating plan for approval at least three (3) months prior
to project abandonment;

11. The Proponent shall allow DENR-EMB Personnel with valid identification
card and travel/mission order to conduct inspection/monitoring in the
entire premises even without prior notice to monitor compliance with
ECC conditions and other environmental laws, and implementation of
approved EMP. Further, on-the-spot monitoring and inspection can be
initiated by the DENR any time in coordination with concerned parties;

II. RESTRICTIONS
12. No other activities shall be undertaken other than what were stipulated
in the IEEC. Any expansion of the project beyond the project description,
or any change in the activity or transfer of location shall be the subject of
a new Environmental Impact Assessment;

13. This Certificate shall be considered automatically revoked if the project


has not commenced within five (5) years from the date of ECC issuance.
The date of project implementation is the date of ground breaking, based
on the proponent's work plan as submitted to the EMB; and

14. Transfer of ownership of this project shall carry the same conditions and
restrictions and the transferee shall be required to notify the EMB RO1
within fifteen (15) days from the transfer of ownership to allow the
necessary changes brought about by such transfer.

Annex B
PROJECT ASSESSMENT PLANNING TOOL
For the assistance of the Proponent and the Government agencies
concerned in the management of the Project and for better coordination in
mitigation of the impacts of the Project on its surrounding areas and the
environment, these recommendations are forwarded to the parties and
authorities concerned for appropriate action.

Code of the Philippines;
2. Compliance with the Labor Department of Labor and

4. Compliance with the Ecological LGU Concerned
Solid Waste Management Act.
5. Secure tree cutting permit Department of Environment and

regulations and requirements
ENVIRONMENTAL PLANNING RECOMMENDATIONS FOR THE PROPONENT
7. Priority of employment shall be given to qualified local residents.
Adequate public information on jobs available to local residents in the
affected areas shall be provided;
