AFFIDAVIT OF OWNERSHIP

OF A PARCEL OF LAND

I, HERMO GINES, of legal age, Filipino, married and a resident of Barangay


Babag, Cebu City after having been duly sworn to in accordance with law, hereby depose
and state, to wit, that:

1. I am the Defendant in an Ejectment case entitled Bien V. Nido vs. Hermo Gines;

2. I am the owner and lawful possessor of the disputed land known as Lot 1, Block 1
of Original Certificate of Title No. 6969 situated at Barangay Babag, Cebu City
since 1973;

3. I have been religiously paying taxes for the aforementioned property since 1973
up to this day;

4. I have not received any monetary compensation in exchange for vacating the
subject property;

5. THEREFORE I am executing this affidavit to attest to the truth that I have been in
open, public, peaceful, uninterrupted and exclusive possession and in the concept
of an owner of land subject to this case for over forty (40) years and for any
purpose it may serve.
