PURPOSE

The purpose of this policy is to support the enforcement of good safety performance
and to eliminate repeated or continuing safety violations by the use of appropriate
disciplinary measures. A subsequent tie up with AP safety license program provided
for the disciplinary procedure for all employees to suit the new circumstances and
project requirements.

SCOPE AND OBJECTIVES

This document is applicable to all NSH employees including any sub-contractors


under NSH.
The primary objective of the company safety program is to provide a safe work
environment for all employees. Safety Induction will be given to all employees
explaining all safety procedures and instructions for the ASU project including
disciplinary procedures to all employees prior to assigning them to project. Managers
or supervisors are required to issue appropriate specific safety instructions and safe
work methods to all employees prior to assigning them work.

Managers or supervisors are responsible for coordinating work with other supervisors
in the work area to ensure that all work can be accomplished safely. Each employee
is individually responsible for complying with each of the provisions of the Safety
Program.

When Safety Policies and Procedures are violated or individuals continue to be


involved in accidents or infractions, disciplinary action must be considered, in order
to emphasize the gravity of the situation and bring about desired improvement.

GENERAL

Every employee of subcontractor and lower-tier subcontractor is considered a


valuable asset, and therefore must be afforded the opportunity to be informed of
Project and HSE expectations and requirements relative to their behaviour and
performance on the project.
This procedure provides a framework for utilization by all concerned personnel or
other person(s) behaviour, and safety performance dictates a disciplinary action.

This not intended to be viewed or administered as an inflexible formula that results


in discipline that would effectively remove a supervisor's discretionary authority in
all cases. It will be administered fairly and consistently with regard to all personnel,
regardless of position and seniority.

Any disciplinary action shall be administered in accordance with company policy,


project policy and local labour laws & practices.

RESPONSIBILITIES
HR Department is fully responsible to select experienced qualified workers who are
able to perform their duties safely.
HSE Manager shall be responsible for advising the corporate management on the
formulation, administration and revision of the HSE policies and disciplinary
procedures.
The Project Management is ultimately responsible for the implementation of the
Disciplinary Procedures.

Managers, Unit Managers are responsible for coordinating work with other supervisors
in the work area to ensure that all work can be accomplished safely. Any unsafe

practices done by his sub ordinates will be taken into action according to this
procedure.
HSE Trainer is responsible to give adequate training for all employees working at
site.
HSE officers are responsible to advice all employees on project safety requirements
and procedures on site and to monitor them whether they are violating or not. If
they are violating any safety rules, implement the disciplinary actions as described in
this procedure.
Each employee is individually responsible for complying with each of the provisions
of the Safety Program.
Examples of conduct which may lead to disciplinary action under this procedure
include but not limited to:
Unsatisfactory attendance record (Absenteeism)

Poor work standards (Quality and Quantity of work)


Breach of health and safety rules (Security violation, Traffic violation etc)
Bullying, fighting, harassment
Refusal to obey reasonable instructions
Negligence
Abuse of client

Insubordination
Improper language
Intoxication or drinking

SEQUENCE OF GIVING DISCIPLINARY ACTION

Every effort will be made by the employee’s immediate supervisor/manager or HSE

personnel in charge to address shortcomings in work standards or violating the rules,

conduct or attendance through informal counselling without invoking the disciplinary

procedure. When an employee commits safety violation, he shall be given verbal

warning (without written letter). When the offense is considered more than minor,

the supervisor will give the employee a Disciplinary Letter as First Offense and will

collect his safety licence and inform Air Products to put two negative points.

On the first offense, the employee will be given lessons learned by the supervisor
and/or safety officer. A disciplinary letter shall be served.

On the second offense (even on different offense), a Final Warning Offense shall be
given and will put 3 more negative points on safety license from Air Products. As per
the seriousness of the violation there will be some penalties considered beyond
warnings such as day or days in camp without pay.

The next violation shall mean removal or termination from site. The employee shall
be given Discipline Letter with Dismissal penalty along with five more negative points
by Air Products. He shall be accorded due process to let himself explain verbally and
in writing.

An employee can also be given Discipline Letter related to an incident where he is


involved if mandated as one of the corrected actions.

On some serious offenses, an investigation shall be called to all involved employees.

Individual written statements shall be taken to document the disciplinary action.

If the violation is one of the listed in “5 fatal safety absolutes”, the penalty is
removal from site if found guilty of the violation.

Excellent attitude and adherence to standards by the offender on upcoming periods


will be considered as positive attitude and will recommend the AP HSE team for
reward and give positive points on safety license.

DISCIPLINARY LETTER

The disciplinary letter is a written document to record the offense of an employee.

The discipline letter shall contain the following details;

• The date warning was given


• Supervisor of offending employee
• Job title of the immediate supervisor
• Department of the involved employee
• Name of offending employee with NSH ID no.
• Job title of the offending employee
• Site where the violation happened
• Type of offenses the employee committed
• Description of the violation or offense
• Penalty or No. of Offense (to be filled in HSE department
• Date when the violation or offense happened
• Time of the violation or offense
• Specific location where the violation or offense happened
• Immediate supervisor’s explanation and signature
• Offending employee explanation and signature
• Approval signatures of the disciplinary action (Const. Manager, HSE
Manager and Project Manager)

RECORDING AND CONSEQUENCES

 Hard copy files of discipline letters are kept in HSE Department.


 The database file is ready to be shared with the Contractor upon request.
 Offending employees shall not qualify the safety recognition and awards
program for earlier than the period of six months.
 Offending employees can join the monthly safety observation awards.
 Supervisors with more than three offender employees in a month shall not
qualify for the safe supervisors of the month.
 Supervisors with three offender employees shall not receive the entitled
monthly allowance/incentives.

CATEGORY OF OFFENSES AND VIOLATIONS

“Zero Tolerance Offenses” – suspected employee(s) violating the “Zero Tolerance


Policy” shall be suspended from work until investigation is completed. Maximum
penalty can be removal from site.

• Not wearing personal protective equipment (PPE) at work site


• Minor traffic violation (wrong parking)
• Blocking of emergency equipment or exits
• Using unapproved scaffolding
• Not keeping proper housekeeping
• Not discharging/handling/storing/transporting effluents/wastes as per the
guidelines
• Failure to barricade hazardous activity.
• Other violations that may be classified as under the Zero Tolerance policy,
that will be determined by the HSE department.

The following are examples of serious violations


• Theft
• Deliberate damage to property
• Fraud or deliberate falsification of documents
• Gross negligence or dereliction of duties
• Gross insubordination
• Incapacity to perform duties due to being under the influence of
alcohol, prescribed drugs or misuse of prescribed medication
• Serious breach of health and safety rules
• Serious breaches of confidentiality
• Serious bullying, sexual harassment or harassment
• Smoking in no-smoking areas.
• Fighting or physical assault with other employees.
• Permit to Work violation or Working without Permit.
• Unauthorized erection, modification or dismantling of scaffold.
• Unauthorized removal of grating floor.

AP’s SAFETY LICENSE PROGRAM

NSH employees or Subcontractor employees, those working under ASU project is


cover all the rules and regulation of AP’s Safety License Program. If any said
employees attained 10 punches in their Safety license card, they will terminate from
the ASU project immediately.

THE RIGHT TO APPEAL

If the employee wishes to appeal against any NSH disciplinary decision, they must
appeal, in writing, within five working days of being notified of the decision. An
investigation will be conducted by HSE and Employee representative who are
acceptable to both parties.
The offender will be requested to attend a meeting to hear the precise details of
the violation at the earliest juncture and without undue delay. The employee will be
advised of his right to be accompanied at this meeting by a representative or work
colleague.

PROTECTIVE MEASURES

Reassigning the employee to other duties


Providing an appropriate level of supervision
Putting the employee off duty with pay

The views of the employee will be taken into consideration when determining the
appropriate protective measures to take in the circumstances but the final decision
rests with management.

Putting the employee off duty pending the outcome of the investigation will be
reserved for only the most exceptional of circumstances. The employee concerned
will be advised that the decision to put him/her off duty is a precautionary measure
and not a disciplinary sanction or an indication of guilt.
