PURPOSE
The purpose of this policy is to support the enforcement of good safety performance
and to eliminate repeated or continuing safety violations by the use of appropriate
disciplinary measures. A subsequent tie up with AP safety license program provided
for the disciplinary procedure for all employees to suit the new circumstances and
project requirements.
Managers or supervisors are responsible for coordinating work with other supervisors
in the work area to ensure that all work can be accomplished safely. Each employee
is individually responsible for complying with each of the provisions of the Safety
Program.

GENERAL
RESPONSIBILITIES
HR Department is fully responsible to select experienced qualified workers who are
able to perform their duties safely.
HSE Manager shall be responsible for advising the corporate management on the
formulation, administration and revision of the HSE policies and disciplinary
procedures.
The Project Management is ultimately responsible for the implementation of the
Disciplinary Procedures.
Managers, Unit Managers are responsible for coordinating work with other supervisors
in the work area to ensure that all work can be accomplished safely. Any unsafe

practices done by his sub ordinates will be taken into action according to this
procedure.
HSE Trainer is responsible to give adequate training for all employees working at
site.
HSE officers are responsible to advice all employees on project safety requirements
and procedures on site and to monitor them whether they are violating or not. If
they are violating any safety rules, implement the disciplinary actions as described in
this procedure.
Each employee is individually responsible for complying with each of the provisions
of the Safety Program.
Examples of conduct which may lead to disciplinary action under this procedure
include but not limited to:
Unsatisfactory attendance record (Absenteeism)
Insubordination
Improper language

warning (without written letter). When the offense is considered more than minor,
the supervisor will give the employee a Disciplinary Letter as First Offense and will
collect his safety licence and inform Air Products to put two negative points.
On the first offense, the employee will be given lessons learned by the supervisor
and/or safety officer. A disciplinary letter shall be served.
On the second offense (even on different offense), a Final Warning Offense shall be
given and will put 3 more negative points on safety license from Air Products. As per
the seriousness of the violation there will be some penalties considered beyond
warnings such as day or days in camp without pay.
The next violation shall mean removal or termination from site. The employee shall
be given Discipline Letter with Dismissal penalty along with five more negative points
by Air Products. He shall be accorded due process to let himself explain verbally and
in writing.
If the violation is one of the listed in “5 fatal safety absolutes”, the penalty is
removal from site if found guilty of the violation.

If the employee wishes to appeal against any NSH disciplinary decision, they must
appeal, in writing, within five working days of being notified of the decision. An
investigation will be conducted by HSE and Employee representative who are
acceptable to both parties.
The offender will be requested to attend a meeting to hear the precise details of
the violation at the earliest juncture and without undue delay. The employee will be
advised of his right to be accompanied at this meeting by a representative or work
colleague.
PROTECTIVE MEASURES
The views of the employee will be taken into consideration when determining the
appropriate protective measures to take in the circumstances but the final decision
rests with management.
Putting the employee off duty pending the outcome of the investigation will be
reserved for only the most exceptional of circumstances. The employee concerned
will be advised that the decision to put him/her off duty is a precautionary measure
and not a disciplinary sanction or an indication of guilt.
