APPLICATION FOR SEARCH WARRANT

COMES NOW, the undersigned Chief of Police of Police Station 5,


General Santos City Police Office, located at Calumpang, General Santos
City, unto this Honorabale Court, most respectfully avers;

1. That the undersigned applied for Search Warrant in this Court and
not in any other court considering that the residence of the respondent is
located within the territorial jurisdiction of the same; he being a resident of
Lot 6, Blk 8, Deca Homes Subdivision, Calumpang, General Santos City;

2. That I was informed that Juan Tamad, married, Filipino and a resident
of the afore-said place is keeping in such residence a caliber .45 pistol and
M16 Rifle, which act is in violation of Section 28 of RA 10591;

3. That I caused the investigation and verification of said report.


Witnesses police officers Jason Poquiz and James Jurado, who were able to
gain entry in the residence of the respondent confirmed to me that the
report is absolutely true;

4. That they have gained entry thereat during the respondent’s birthday
party in which he invited some of the police officers of this station including
the above-said police officers;

5. That based on their report, respondent keeps the said firearms inside
his master’s bedroom on said address;

6. Attached are the following to support this application:

a. Certification from the Purok Chairman of Deca Homes Subdivision


confirming, among others, that Lot 6, Blk 8, Deca Homes Subdivision,

Calumpang, General Santos City is the exact residence of Juan
Tamad;
b. Affidavit of Police Officer Jason Poquiz;
c. Affidavit of Police Office James Jurado;
d. Vicinity sketch of the location of the house;
e. Sketch of the house and location of the items to be seized; and
f. Negative Certification from the FEO;

7. WHEREFORE, the undersigned respectfully prays that this honorable


court issue a search warrant against the respondent authorising the
undersigned or any police officer to search the premises described in this
application; and to seize and bring to this court the things or properties
enumerated herein.

1. I am the applicant and I prepared this application for search warrant,


read and understood all the allegations therein;

2. The same are true and correct of my own knowledge; and, on the
basis of authenticated documents in my possession;

3. That I have not commenced any application for search warrant


against the same party in any court, tribunal or other agency and that to
the best of my knowledge, no such application is pending in any court,
tribunal or agency and if I learn that a similar application has been filed or
pending before any court, tribunal or other agency, I shall make the
required notification within five (5) days from receipt thereof;
