AFFIDAVIT OF DESISTANCE AND QUIT CLAIM

I, _________________, of legal age, Filipino citizen, and a resident of Cagayan


de Oro City, Philippines, after having been duly sworn to an oath in accordance with law,
hereby depose and say, that:

1. I am one of the complainants who lodged a complaint against [name of


respondent] before the NLRC – RAB No. X, Cagayan de Oro City docketed
as NLRC Case Nos. _________________;

2. On _________, the Honorable NLRC – RAB No. X rendered a decision in


favor of the complainants and against the respondent, [name of respondent];

3. On ___________, the above decision became final and executory as per Entry
of Judgment issued by the NLRC 8th Division;

4. By virtue of the Motion for Execution dated _________ filed by the


complainants, respondent’s bank accounts in BDO, BPI, and Metrobank were
garnished in the total amount of One Hundred Seventy Eight Thousand Pesos
(P 178,000.00);

5. Since the garnishment was not enough to satisfy the judgment award,
respondent’s properties with TCT Nos. ____________ were further levied and
thereafter sold through auction sale;

6. Thus, I and all the other complainants in the aforementioned cases received all
that was due us by reason of the judgment award by the NLRC with the total
amount of Two Million Eight Hundred Sixty Seven Thousand Three Hundred
and Fifty Nine 50/100 Pesos (P 2,867,359.50);

7. In order to reacquire the auctioned properties, [name of respondent] issued a


check in the amount of ________________ to me and the other complainants
who were also the buyers of the auctioned properties;

8. The check issued likewise covers the Sheriff’s Fees for the garnishment, levy,
and auction sale;

9. As such, I waive all my interests, claims, and whatever rights I have over the
auctioned properties which I acquired by virtue of the judgment award by the
NLRC;

10. By signing this affidavit, I relinquish myself from any legal entanglement
appertaining to the above-stated case;

11. Consider this case as settled, I having effectively received what is due me by
virtue of the NLRC judgment award;

12. This affidavit is executed by me and of my own free will and volition for the
purpose of settlement with [name of respondent];

13. I hereby waive all present and future rights and claims pertaining to said
judgment award.
