In writing a position paper one of the most important elements is the claims.

Identifying claims is not


that complicated when you have enough knowledge about each claim type. The position paper about
Legalizing Divorce in the Philippines, the author used bunch of phrases that contains claim of fact, value
and policy. In consideration to the readers who are going to read the position paper, the author used
these claims to encourage the people to believe on what they are reading.

Claim of facts, Marriage is the process by which two people make their relationship public,
official and permanent. The ethno-linguistic communities of the Philippine archipelago before Spanish
conquest practice divorce, we had a divorce law from 1917 until August 30, 1950, when the Civil Code of
1950 took effect, the latter law (divorce law from 1917) prohibited divorce for Filipinos, and the
prohibition continues under the present Family Code and the Code of Muslim Personal Law of the
Philippines (Presidential Decree No. 1083), promulgated in 1977. These claims give evident information
to support the argument but the claims are not the real fact, it is just claims that cannot be confirmed so
the author used established facts to persuade the reader with something that already existed or will
exist.

Claim of Value, No marriage is free of conflicts, It is the fight to make divorce legal in the
Philippines, Divorce does not concern itself with validity or invalidity of marriage, compare to women
men are more aggressive, and stronger when it comes to strength, Not all marriage was joined by God,
which make sense that any of the religious beliefs do not have the right to hinder our country in
legalizing divorce which is beneficial otherwise, It could promote a healthy marriage and family through
the succession of finally approving or legalizing divorce in the Philippines, A divorce is an open door for
every individuals to escape. This claim is used to persuade readers to agree or oppose about the
legalization of divorce in the Philippines.

Claim of Policy, Marriage is sacred and a must, it is lawful which should follow and taken care by
a marriage people or family. The law should only give people a choice to be exercised according to their
own personal beliefs. Non- divorced Catholics need to be careful of assumptions to discard any trace of
judgment toward the divorced, divorce should legalize to avoid adultery. Therefore, this claim is used to
convince the readers or the government to take some changes in behavior to solve the problem.

These claims are used to support the idea and prompt the readers to agree, accept or oppose in
an argument by giving some ideas for them to understand the real meaning and the concept of divorce.
