Dionesio Tangol testifies that on the night of August 2, 2014, he and his coworker Virgil Sollozzo went for drinks at a local bar after work. While there, the victim became verbally abusive towards Tangol before leaving. Sollozzo followed to confront the victim, who then attempted to drive away aggressively, running over Sollozzo. Q1. Do you swear to tell the truth and nothing but the truth?
A1. I do, Sir.

Q2. Are you aware that you may face criminal liability for false
testimony or perjury if you will not tell the truth?
A2. I am, Sir.

Q3. Please state your name, age, address and occupation.


A3. I am Dionesio M. Tangol, single, 35 years old, residing at P-Rosas,
Brgy. Washington, Surigao City, and employee of a private business
enterprise in the City.

Q4. Do you know the accused in this instant case, Mr. Virgil Sollozzo?
A4. Yes, Sir. He is my co-employee.

Q5. Do you know what day and what time does Mr. Virgil Sollozzo goes
to his work?
A5. Yes Sir, He is always at Bibo Enterprises working on Monday to
Saturday from 8:00 in the morning until 5:00 in the afternoon.

Q6. After work, do you always go home together with Mr. Virgil
Sollozzo?
A6. Yes Sir. We always go home together because we live in the same
area.

Q7. At the night of August 2, 2014, do you remember being with Mr.
Virgil Sollozzo?
A7. Yes, Sir. We went to Abansa Resto Bar.
Q8. Can you tell us what time?
A8. At around 10:30 in the evening.

Q9. Aside from Mr. Virgil Sollozzo, do you have any companion?
A9. No more Sir, it was only the two of us.

Q10. Why were you there?


A10. Because it was our payday earlier that day, and my companion Mr.
Virgil Sollozzo, treated me in the said resto bar.

Q11. Where were you seated?


A11. We sat near the entrance of the said resto bar.

Q12. Was there anything unusual that occurred before you left the
place?
A12. Yes, Sir. Before we left the resto bar, the victim went out and
started to utter offensive languages towards me as he was headed out.

Q13. What happened next?


A13. My companion Mr. Virgil Sollozzo followed the victim outside
and said to him “Kul, imo man tagbastos ako kaiban”.

Q14. What did the victim reply?


A14. He said in a strong voice “Kay uman kung tag-bastos, mu awai
kaw?”.

Q15. After that what happened?


A15. The victim mounted his motorcycle. And started to switch the
ignition.

Q16. What did you and Mr. Virgil Sollozzo did?


A16. Mr. Virgil Sollozzo tried to prevent the victim from driving his
motorcycle by using his body as a blockade.
Q17. What happened then to your companion?
A18. He was overrun because, the victim switch gear and suddenly pull
down the throttle of the motorcycle as a consequence thereof Mr. Virgil
Sollozzo fell down.

Q19. After that incident what happened?


A19. The victim pulled over to a stop and went back to Mr. Virgil
Sollozzo and as he was approaching, he took something out from his
back pocket.

Q20. Did you see what he pulled from his back pocket?
A20. Yes, Sir. He took a knife and held it his right hand.

Q21. What did you do?


A22. I shouted in a loud voice “Pre pag-bantay kay jaoy ija kutsilyo”.

Q22. What did you witness next?


A22. While Mr. Virgil was trying to get up and saw the victim
approaching, the victim tried to land a stabbing blow to Mr. Virgil but to
no avail. Because Mr. Virgil manage to grapple for the possession of the
knife wielded by the victim, the victim was stabbed as a result.

Q23. So Mr. Virgil was not at fault in this case.


A23. Yes, Sir.

Q24. This happened in the early hours of August 3, 2014?


A24. Yes Sir.

Q25. Do you have anything more to add in your affidavit?


A25. No more Sir.
