BUILDING BYE-LAWS
TEHSIL MUNICIPAL ADMINISTRATION, CHAKWAL
NOTIFICATION

No. TMA-CKL/1631 Dated 01-07-2003

In exercise of the powers conferred on me under Section 192 read with S.54(1)(e) and
Clause 39 of 6th Schedule of the PUNJAB LOCAL GOVERNMENT Ordinance 2001, I,
Ch. Muhammad Amir Khan Bhatti, Tehsil Nazim Chakwal, hereby enforce, with the
approval of Tehsil Council Chakwal the under mentioned Building Bye-laws in super
cession of the previous Building Bye-laws published in the Punjab Government Gazette
Notification No.746/TPO/GB/MCC dated 13 November, 1995 for general information.

PART - 1
PRELIMINARY

1. Short Title and Commencement.

i) These bye-laws may be called Tehsil Municipal Administration Chakwal


(Erection and Re-erection of Building Bye-laws 2003.

ii) These Bye-laws shall extend to the whole Tehsil Chakwal except the areas
exempted by the Tehsil Council, Chakwal.

iii) These Bye-laws shall come into force with effect from 1st July, 2003.

2. Regulation of Erection and Re-erection of Buildings.

i) No person shall erect or re-erect a building or commence to erect or re-


erect a building on any land without prior sanction of Tehsil Municipal
Administration Chakwal.

ii) Tehsil Municipal Administration Chakwal may for reasons to be recorded


in writing reject a site or building plan.

iii) The Tehsil Municipal Administration Chakwal may sanction any erection
or re-erection of a building either absolutely or subject to modifications as
it deems necessary.

PART -II
GENERAL ADMINISTRATIVE MATTERS

3. Interpretation of Terms.
Unless otherwise expressly stated, the following terms shall for the purpose of
these Bye-laws have the meanings indicated in this part. Where the terms are not
defined they shall have their ordinarily accepted meaning of such as the context
may apply.

i. Administration - means Tehsil Municipal Administration Chakwal.


ii. Approved Scheme - means a project approved by the competent authority
for Urban Development.
iii. Arcade - means a covered footpath for pedestrians in front of a shop in
commercial building.
iv. Balcony - means a stage or platform projecting from the wall of a building
surrounded with a railing or parapet wall.
v. Base - means the underside of the course immediately above the footings
applied to a wall or pillar.
vi. Basement - means the lowest storey/storeys of a building, partly or wholly
below the ground level.
vii. Building Clerk - means the clerk of Planning & Coordination Office.
viii. Building Inspector - means the building inspector of Planning &
Coordination Office.
ix. Building Works - means the site excavation, erection or re-erection of
building or making additions/alterations.
x. Building/House Line - means a line beyond which the outer face of any
building except compound wall, may not project in the direction of any
road or street existing or proposed.

xi. Cardinal Points - means the directions of North, South, East and West.
xii. Commercial Building - means a building having shops or show rooms,
offices, hotel, private school, filling/servicing station etc. and may also
have housing units/apartments.
xiii. Competent Authority - means the Nazim, or authorized officer by the
Nazim to approve plans and to control the building activity.
xiv. Council - means Tehsil Municipal Council, Chakwal.
xv. Damp Proof Course (DPC) - means a layer of material impervious to
moisture.
xvi. Draftsman - means draftsman of P & C office.
xvii. Floor Area Ratio - means the aggregate covered area of the building on a
plot divided by the total area of the plot.
xviii. Foundation - means a structure entirely below the level of the ground
which carries and distributes the load from pillars, beams or walls on the
ground.
xix. Gallery - means an open or a covered walk-way or a long passage or an
underground passage.
xx. Government - means the Government of Punjab.
xxi. Industrial Building - means a building designed for use as a factory or
workshop and includes an office or other accommodation on the same site,
which is intended for use in connection with the mining or minerals
including brick or the earth or warehouse, depository or stores etc.
xxii. Kacha Building - means a building having walls made of bricks/stones laid
with mud, roof material grass, hay, straw, reed temporarily made for
residence or animal shelter.
xxiii. Kanal - means a size of land equal to 20 marlas @ 272 sft. as in revenue
papers and @ 248 sft. as otherwise described and generally applied in
Chakwal city.

xxiv. Licensed Architect/Town Planner/Draftsman - means a person qualified as


such enrolled on the list of approved architects/town planners/draftsmen
maintained by the Tehsil Municipal Administration Chakwal.
xxv. Market - means a group of shops assigned particularly for one or more
specified trades.
xxvi. Marla - means a spatial unit of 272 sft. as in revenue papers and 248 sft. as
otherwise described and generally applied in Chakwal City.
xxvii. Multi-storey Building - means any building having more than one storey.
xxviii. Nazim - means Nazim of Tehsil Municipal Administration, Chakwal.
xxix. Ordinary Repair - means painting white washing, plastering, paving and
minor alterations to a building.
xxx. Parapet - means a wall, whether plain, perforated or paneled, protecting
the edge of a roof, balcony, verandah or terrace.
xxxi. Pergola - means a structure with perforated roof consisting of cross bars in
the form of re-enforced concrete, wood or steel etc. of which more than
50% of roof is open to the sky.
xxxii. Place of Public Worship - means a building or institutes of building
designed for a purpose associated with the performance of religious
functions.
xxxiii. Plinth - means the portion of the building between the level of the site and
the level of the ground floor.
xxxiv. Public Building - means a building designed for public use and may
include a dispensary, post office, police station, tanga or transport stand,
town hall, library, cultural centre and premises of social agencies such as
hostels etc.

xxxv. Residential Building - means a building exclusively designed for the use as
a human habitation together with such other uses as are ordinarily ancillary
to the main building and used in connection therewith.
xxxvi. Semi Detached Building - means two buildings but on adjacent plots
having a common partition walls.
xxxvii. Septic Tank - means a tank in which sewage is collected and decomposed
before its discharge into a public sewer or soakage pit.
xxxviii. Soakage Pit - means a pit filled with aggregate, boulders or broken bricks
and intended for the reception of waste water or effluent discharged from a
septic tank.
xxxix. Sq. Ft. - means Square Feet.
xl Structural Calculations - means detailed calculations showing sufficiency
of the strength of every load bearing part of the proposed structures.
xli. Sun Shade - means an outside projection from a building over minimum
height of 7 feet from the plinth level meant to provide protection from sun
and rain.
xlii. Structural Engineer - means Civil Engineer having Msc Degree in
Structural Engineering and registered with Pakistan Engineer Council as
Structural Engineer
xliii. Tehsil Municipal Administration (TMA) - means Tehsil Municipal
Administration Chakwal.
xliv. Tehsil Officer Planning & Coordination TO (P&C) - means Tehsil Officer
Planning & Coordination, Tehsil Municipal Administration Chakwal.
xlv. Verandah - means a roofed gallery, terrace or other portion of a building
with at least one side open to courtyard or a permanent open space.
xlvi. Zone - means an area/areas earmarked for particular use of character
including an area in which sizes of plots have been prescribed.

PART -III
4. Application of Building Bye-Laws. Every prospective builder who intends to
carry out building works within the boundary of the area controlled by the Tehsil
Municipal Administration shall comply with the requirements of these Bye-laws.

5. Submission of Plans
i.. All applications shall be made on building application Forms A & B as
prescribed by the Tehsil Municipal Administration at Appendix A & B.

ii. The land shown as set-back on the building plan for street or road
widening or parking shall vest in the Tehsil Municipal Administration
Chakwal
iii. No building application shall be entertained unless the plan is drawn by an
Architect/Town Planner/Draftsman holding the license for the said
purpose issued by the Tehsil Municipal Administration.

iv. Only those Architects / Town Planners shall be registered who keep a
Degree or Diploma in Architecture / Town Planning from a recognized
University. Draftsman holding diploma as Civil Draftsman from a
Government recognized Institute can be registered as Architect provided
they keep work experience not less than three years and Tehsil Officer
Planning & Coordination is satisfied with their practical performance.

v. If at any time it is found that any licensed Architect / Town Planner /


Draftsman has drawn any building plan against the site or is guilty of any
such action which is prejudicial to the Municipal or public interest, the
Tehsil Municipal Officer on the report of Tehsil Officer (Planning &
Coordination) may cancel his license or may impose a fine on such
Architect / Town Planner / Draftsman which may extend up to Rs.5,000/-
(Rupees five thousands).

vi. Every person intending to erect or re-erect a building shall give notice of
such intention in writing to the Tehsil Municipal Administration by
submitting Form - An appended to these Bye-laws, in order to
obtain permission to execute work, shall at the same time submit:

a. Certified / attested copy of the sale or gift deed, Farad, Jamabandi


or other documents of title where under the applicant claims or
derives ownership of the land or building sought to be erected or
re-erected.

b. Attested copy of the National Identity Card of the owner/owners of


land.

c. An affidavit declaring that builder will abide by building bye-laws


of Tehsil Municipal Administration and that during the course of

Construction, he / she will not encroach upon any public or


Government land. That the documents provided by him / her along
with building plan are correct and nothing has been concealed from
the Tehsil Municipal Administration regarding ownership of the
property / plot and that if at any stage it is proved that documents
provided by him / her were incorrect, he / she will be solely
responsible for this act with no liability accruing the Tehsil
Municipal Administration.
d. The specifications detailed in Form B appended to these bye-laws.
e. A key plan drawn to a scale of 100 feet to an inch (1:1250) or other
suitable scale to show the site to which it refers, showing all the
roads and streets etc. leading to the proposed site from the nearest
road or point of significance.
f. A site plan on tracing cloth / paper, of the land on which it is
intended to erect or re-erect the building, drawn to a scale of not
more than 1/16th of an inch to a foot (1/16”: 1’-0”) and not less
than one inch to 40 feet bearing an index explaining any special
colours and symbols and shall be submitted in duplicate showing
North position of the proposed or existing building. The width and
level of the streets or road on which the plot abuts, the adjoining
plot numbers if any together with cardinal points and land use of
the surrounding buildings should also be indicated.
g. Plan, Section and Elevation of every floor including basement, if
any intended to be erected which shall be drawn to a scale of not
less than 1 inch to 8 feet (1:100) or if the building is so extensive
as to make a smaller scale necessary not less than 1inch to 16 feet
(1:200) . Such Plans, Sections shall show the purpose for which
the building and roof are intended to be used and access to and
from several parts of the building and its appurtenances, the
position from and dimensions of foundations, the proposed height
of plinth and supper structure at the level of each floor, roof,

column, beam joints and girder, position of all proposed drains,


privies, latrines, urinals and cesspools, position and dimensions of
all projections beyond and main outer walls of the building, the
scale on which the plan is drawn and the North sign.
(1) All new works should be indicated on the plan by a Brown
colour on the plan.
(2) In both site plan and the building plan. all existing features,
namely buildings and other land marks shall be shown in
BLUE, proposed new features Red and proposed
demolition in Green.
(3) For each floor plan a separate block plan will be shown on
the drawing clearly dimensioned / indicating the covered
area.
h. Specifications and calculations of design regarding the material
and method of construction to be used for external walls, partition
walls, foundations, roofs, ceilings, floors, stair cases, fire places
and chimneys.
i. Every prospective builder who intends to make any addition or
alteration to a building as a result of which the original covered
area will increase or where changes are such as to alter the original
plan, shall submit an application along with the documents
giving detailed information about the alteration as required under
these Bye-laws, and a certificate from a qualified structural
Engineer to verify the stability of the building / structure, to the
Tehsil Municipal Administration for permission to execute the
work.
j. Every construction plan submitted under these Bye-laws shall be
prepared by a licensed Architects / Town Planners / Draftsman or
under his supervision, shall bear his stamp, signature and
registration number.
k. Every Construction Plan for Commercial building under these bye-
laws shall be prepared by the license Architects / Town Planners /
Draftsman or under his supervision, and every prospective builders
shall submit structural stability certificate of the buildings issued
by structural Engineers shall bear his stamp, signature and
registration number with Pakistan Engineering Council.

6. Fees and Penalties


i. Tehsil Municipal Administration shall charge fee for the scrutiny
of building plans required to be submitted under these Bye-laws
and other matters arising during the disposal of plans or in the
course of its construction. This fee to be known as “Building
Application Fee” on covered area at the rate of Re.1/- per square
foot, or in such manner as may be revised from time to time in the

schedule. This fee shall be “non-refundable” whether the plan is


approved or rejected.
ii. Tehsil Municipal Administration may exempt from the payment of
Building Application Fee, the premises which in the opinion of the
Tehsil Municipal Administration will be used for religious or
charitable purposes, but NOC from concerned authorities for the
purpose shall be produced with other documents required for
approval.
iii. Serving and retired employees of the Tehsil Municipal
Administration shall be exempted from the payment of Building
Application Fee for their personal owned premises only once in life
time.
iv. If any developer of a building makes any violation from these bye-
laws and approved plan, a penalty may be compounded on such
violation by the Tehsil Officer Planning & Coordination as
prescribed in the Annexure-A.
v. The rate of Building Application Fee and Penalties can be revised
from time to time by the Tehsil Municipal Administration.
7. Registration of Application
Every building application plan and specifications referred to in the
proceeding bye-laws shall be signed by the applicant and submitted to
Tehsil Municipal Administration on Form-A appended to these Bye-laws.
Applicant shall deposit advance building application fee, and on payment
of such fees every building application fee shall be registered in the
register of building applications maintained by Tehsil Municipal
Administration along with Form-B appended to these bye-laws. If the
applicant within 45 days of the submission of plan, does not receive any
notice of approval, disapproval, amendment in the plan, provision of any
other document etc. from the Tehsil Municipal Administration, shall send
another notice to the Tehsil Municipal Administration for consideration of
his application through registered mail. And if within 15 days of the
receipt of this registered notice, no action is taken/intimated by the Tehsil
Municipal Administration, the plan shall deemed to be approved up to
the extent it does not contravene the provisions of these Bye-laws.

8. Procedure, Notices, Inspection & Certificates During Construction.

i. Every builder who carries out building works shall use sound building
material which shall be of good quality and properly put together so as to
ensure safety and stability of the building.
ii. A certificate of durability and in accordance with building plan be
obtained from Architect and Engineers concerned after completion of each
floor.
iii. Structure strength according to design be certified by the structural
Engineer after on the spot inspection of the quality of the material
especially of steel and concrete the completion of the building.
iv. In case of failure of the Structure Engineer should be held personal
responsible.
v. If on making inspection, the authorized officer/official of the Tehsil
Municipal Administration finds that the building works:-
a) Contravene any of the provisions of the Bye-laws, Tehsil
Municipal Administration may by written notice require the person
carrying out building work within a period to be specified in such notice,
either to make such alteration as shall be specified in such notice, with the
object of bringing the work in conformity with the said plans or provision
of the bye-laws or get amended plans approved by Tehsil Municipal
Administration after complying with the requirements of the bye-laws.
b) In the event of non-compliance with the requisition as made under
sub clause (i) above, Tehsil Municipal Administration may order cessation
of work or order of demolition of such construction which may contravene
any of the provisions of the building bye-laws and the expenses thereof
shall be paid by the owner.

9. a) Completion Certificate

i. Every prospective builder who carries out and completes building works
as approved under these Bye-laws shall within 30 days of the completion
of work apply in writing to Tehsil Municipal Administration together with
the certificate signed by the licensed Architect/Town Planner/Draftsman,
unless in the opinion of the competent authority such a certificate in not
required.

ii. Tehsil Municipal Administration shall issue a completion certificate on


completion of building works provided the work has been carried out

according to the sanctioned plans or deviation made therein during the


construction are settled in advance in writing by an officer duly authorized
in this behalf.

iii. In case the prospective builder intends to construct the building in phases,
the sequence of construction in phases duly numbered shall be indicated
on the drawings.

b) Lapse of Sanction

Every sanction for the erection or re-erection of building given or deemed


to have been given by the Administration shall be valid for one year from the date
on which it is given, and if the building so sanctioned is not begun within that
period, it shall not thereafter begun unless the Administration on an application
made therefore has allowed an extension of that period.

10. The Making of Survey for the detection of buildings


constructed in an unauthorized manner and taking of action
with regard thereto.

i.. Building Inspector shall make survey of the sites/buildings under


construction from time to time with a view to:-

a. To detect cases of contravention of the provisions of the Punjab


Local Government Ordinance 2001, rules and these Bye-laws.
b. To detect persons erecting or re-erecting buildings without
permission.
c. To ascertain how far the conditions of the sanction for erection or
re-erection of building are being fulfilled.
And building inspector concerned will be responsible for above said duty
under clause i(a),(b),(c).
ii. All information’s regarding the correction, sanction or rejection of plans
and inspection of site, any charges i.e. fee, fines and penalties etc. under

these Bye-laws shall be communicated in writing to the persons concerned


under the signature of Tehsil Officer Planning & Coordination.

iii. The result of every inspection under clause (i) above shall be recorded in
the building form ‘C’ appended to these Bye-laws and brought to the
notice of Tehsil Officer Planning & Coordination who may ensure that

adequate action has been taken with regard to each case of contravention
of the Ordinance or Rule or Bye-laws framed there-under.

iv. The authorized officer of Tehsil Municipal Administration may enter into
or upon any premises with or without assistant in order to make any
inspection, survey, or inquiry, provided :-

a. no such entry shall be made between sunrise and sunset.

b. no building used as a dwelling house shall be so entered unless


with the consent of the occupants there of or after giving the said
occupier at least six hours prior notice in writing of the intention to
make such entry and of the purpose thereof.

c. due regard shall always be had so far as may be compatible with


the exigencies of the purpose for which the entry is made to the
social and religious usages of the occupants of the premises
entered.

d. no claim shall lie against any person aforesaid for compensation


for any damage necessarily caused by effecting such entry provided
that force shall not be used for effecting any entry unless there are
reasons to believe that an offense has been or is being committed
against any of these Bye-laws.

PART - IV

11. Building and Planning Control Requirements ( Residential).

i. No portion of a building in a street or road shall be built to project beyond


the existing line of frontage which in every case shall be taken to be outer
wall of the building.
ii. The building line of the proposed building abutting on any street or road in
the existing localities shall be at a distance of half of the width of the said
street or road from the centre of such street or road and no person shall
erect or re-erect any part of the proposed building towards the street/road
side abutting beyond the said building line.
iii. In all the newly developed areas minimum street width will be 20 feet and
every person intending to erect or re-erect a building shall have to provide
minimum 10 feet wide space from his own land all along the proposed site
for street/streets. In the areas in which a street/streets or road/roads already
exist up to the proposed site or near thereby every person whose building
or site abuts on the said street/streets or road/roads shall have to provide
space equivalent to one half of the total width of the existing street/streets
or road/roads from his own land. In such cases the building line shall abut
at a distance of 10 feet or half of the width of existing street/streets or
road/roads from the centre of such street/streets or road/roads as the case
may be.
iv. Proportion of the site which may be occupied by the building and
corresponding floor area ration shall be as specified in schedule - I.
v. Three feet hanging projection over the courtyard meant for passage shall
not be included in the covered area.
vi. The minimum number of storeys allowed to be constructed is four,
excluding the basement, if constructed.
vii. The top of the plinth of the building shall be at least one foot above the
highest finished level of the adjoining road or street.
viii. Every interior yard must be raised at least one foot above the level of the
crest of nearest street or road so as to admit of easy drainage except floor
of the porch, which should be at such a height from the street or road to
allow easy entrance of the vehicle.

12. Building Heights

i. The height of any building for the purpose of these Bye-laws shall be
measured from the top of the plinth to the top of the parapet wall.
ii. No person shall construct any building abutting on any street:-

a. of a height more than 24 feet if such street is up to 12 feet wide.

b. of a height more than 44 feet if such street is 18 feet wide or more


than 18 feet wide.
c. the Administration / Nazim, may permit mumties, chimneys,

minarets of mosques, mobile phone tower, tower of churches, temples and


similar structures to be constructed to a height in excess of the maximum
height otherwise permissible under these Bye-laws.
iii. Minimum space standard for building interiors shall be as per Schedule - II

COMMERICAL
13. Height of the building

i. Construction of more than 5 storey will not be allowed. Construction of


basement is exclusive to this.

ii. Maximum height of a commercial building shall not exceed 60 feet.

a) Minimum effective height of any shop shall not be less than 9 feet
6 inches without any gallery (storage space) or 15 feet 6 inches
with gallery (storage space).

b) Minimum effective height of parking floors shall not be less than 8


feet.

c) Minimum effective height of a parapet will shall be 2 feet 9 inches.

d) all other floors shall have minimum effective height of 9 feet 6


inches. No open space on either side of the building shall be
required.
iii. Display of neon signs, advertisement etc. shall be on permissible places
subject to the approval of the Administration. The Administration shall
charge necessary fee on each sign, advertisement board at the rate and in a
manner as fixed from time to time.
iv. The minimum floor area of a shop shall be 100 sq.ft. having a minimum
floor width of 8 feet.

14. Set-back Requirements for Commercial & Semi-commercial Buildings

i. In case of commercial and semi-commercial buildings every prospective


builder shall be required to provide 4 feet wide set-back area on the front
of the building situated on the following four major roads:

(1) Rawalpindi Road.

(2) Talagang Road..

(3) Jhelum Road.

(4) Bhaun Road / Sargodha Road.

In all other areas set back is exempted for commercial or semi-commercial


buildings.

ii. The land shown as set-back on building plans shall be surrendered in


favour of Tehsil Municipal Administration through a surrender deed and it
shall never be made a part of the building.

15. GENERAL

i. No land or building shall be used in a manner inconsistent with the use


prescribed by the Administration in the approved plan.

ii. No person shall start building works on a site abutting on a street / road
without having first provided hoarding or barrier to the satisfaction of the
competent authority along the same length of such site so as to prevent
danger of injury to the public or the persons employed to the work
however, this rule does not apply in the case of building work in
connection with structures situated 15 feet away from edge of the public
street and being not more than 25 feet high.

iii. No part of any street shall be used in connection with construction repair
or demolition of any building except with the written permission of the
competent authority. Any person holding such permission shall put up and
maintain to the satisfaction of the concerned authority the fences or
barriers in order to separate the building work from such street without
interruption in the flow of traffic.

iv. No construction material or debris shall be deposited in any street without


the written permission of the competent authority on the condition that the
owner will be responsible for clearing the street after completion of work.
And if the owner keeps the building materials in any street without
permission from TMA, he will be penalized @ Rs. 1.0 per Sq. ft per day.

v. No excavation shall be made in any street without written permission of


the competent authority on the condition that the owner will be responsible
for clearing the street after completion of work.

vi. No excavation shall be made in any street without written permission of


the competent authority. The applicant will inform all concerned
departments/agencies about the date on which he intends to start
excavation along with a copy of sanctioned plan/ the permission.

vii. All materials, hoarding, fences or other obstructions in any street shall be
kept clear of hydrants and other utility services, installations or alternative
arrangements to the satisfaction of the competent authority and precautions
shall be taken to divert or keep clear of obstructing any road side or drain
during the period of temporary construction.

viii. If any material, hoarding, excavation or any other thing in or near any
street be in the opinion of the Tehsil Officer Planning & Coordination
dangerous to the passengers along such street the competent authority shall
cause the same to be removed, protected or enclosed so as to prevent
danger there from and shall be entitled to recover the expenses thereof
from the owner of such material or from the person who made such
hoarding, excavation or the other thing to become dangerous.

ix. The competent authority may give notice canceling any permission issued
for the breach of any of the imposed conditions or for any other reason it
may think fir and person holding the permission shall within 7 days of the

receipt of such notice have hoarding, fence or material removed and any
excavation refilled or otherwise made good.
x. All obstruction and erections in any street shall be removed with in 7 days
of the completion of the work and the street and all drains and public
utility installations shall be left in clean tidy and serviceable condition.

xi. No excavation or earth work, demolition of a building which is likely to


effect the stability of any adjacent building shall be started or continued
unless adequate measures are taken before or during the work to prevent
the collapse of any adjacent building or the fall of any part of it.

xii. A site once excavated shall not be kept open beyond the period stipulated
for completion of the work below ground level.

xiii. Material shall not be placed or stacked near the edge of any excavation to
endanger any person.

xiv. No building may be demolished without a written permission from the


competent authority. No permit to demolish will be issued unless the
Tehsil Municipal Administration is satisfied that the electricity, gas, water,
sewerage or other utility services connections to the plot have been
effectively cut off and such connections remain cut off during the period of
the work.

xv. No roof, floor or the parts of the building shall be so over loaded during
the process of demolition / construction with debris of materials so as to
render it unsafe.

xvi. Every part of load shall be securely fixed or supported while being raised,
lowered or suspended and shall be adequately secured to prevent danger
from slipping or displacement. Every receptacle used for raising, lowering
and suspending blocks, bricks, tiles or other objects shall be so designed
and constructed as to prevent accidental fall of such objects.

xvii. In all buildings where the load of electricity would require installation of
independent transformer / sub-station appropriate space for location and

access shall be provided within the premises as determined by the power


supply agency.
xviii. No tower / antenna be allowed to be erected on a building, whose basic
building plan is not approved.
xix. Any building plan approved by TMA, will not be applicable in any court.
16. Inter Flooring

i. Inter floor shall only be permitted in rooms other than those meant for
habitation purposes, such as bath rooms, stores, kitchen pantries, passages,
garges if combined with the main building, verandahs rooms meant for
similar ancillary uses.

ii. A minimum clear height of all the rooms referred to in clause a. above
shall be as per schedule - II, except that the inter floor may have a clear
height of 5 feet 6 inches when used as storage space.

iii. Any horizontal division of a building so constructed as to be capable of


used as living or sleeping room shall be considered to be storey for the
purpose of these Bye-laws even though such division does not extend over
the whole depth or width of such building.

17. Basement.

i. Whenever a basement is constructed, it shall be subject to the fulfillment


of the following conditions:

a. That is shall be served with an independent entrance and shall have


an emergency exit.

b. That the level of the public sewer permits gravity flow at a gradient
of not less than 1:40 or if this may not be possible pumping
arrangements shall be installed.
c. That minimum height of any basement room shall be 8 feet.

d. That the drainage passing under the basement is gas tight.

e. The minimum area of the basement shall not be less than 100 sq.
ft.

f. The foundation of the basement shall not intrude into adjoining


property.

18. Internal Lighting & Ventilation Including Mechanical


Ventilation

i. Every room other than rooms used predominantly for the storage of goods
shall, except where mechanical arrangements are provided, have a
combined glazed area of not less than 12% of the floor area of such room
and 50% of such opening shall be capable of allowing free uninterrupted
passage of air.

ii. Every latrine, water closet, urinal stall and bath room shall be provided
with natural lighting and ventilation by means of one or more openings in
external walls having a combined area of not less than 2 sq. ft. per water
closet, urinal stall or a bath room and such openings shall be capable of
allowing free uninterrupted passage of air.

iii. Kitchens, lavatories, WCs and bath rooms may have sources of daylight
and natural ventilation from internal air wells of adequate size.

iv. Where permanent mechanical air conditioning is intended to be provided,


the relevant building Bye-laws dealing with internal lighting of rooms
maybe waived off at the discretion of the competent authority.

19. Meaning of Escape in case of Emergency

i. In every multi-storied building, emergency stair case shall be provided in


addition to the main stair case/stair cases.

ii. All means of escape from a building including extra corridors stairs etc.
shall permit unobstructed access to the street.

iii. An emergency stair case shall be sited at such a position that it should be
accessible to all the unit without any hindrance or obstruction and it
should be open to a permanently ventilated space.

iv. All buildings shall have windows on the street elevation within the
convenient reach and of adequate size to enable persons to escape in case
of emergency.

20. Building Structures

i. Sites

a. No building shall be erected upon a site reclaimed with town


sweeping or other refuse until the whole ground surface or site of
such building has been rendered or become innocuous and has
been covered with a layer of clean earth, sand, hard core clinker or
ash rammed solid at least 12” thick.

b. Boundary walls which abut on public streets, footways or places


which the public are allowed to use shall not have fencing
consisting of barbed wire or any material likely to cause injury to
humans or animals.

ii. Foundations

a. The foundation of any building shall be wide enough to allow the


distribution of load on each sq. ft. not exceeding one and a quarter
ton. No building shall be built upon newly filled earth till it had
ample time to settle down and not even then without the special
permission of the Tehsil Municipal Administration, Chakwal.

b. The owner shall cause tests to be made to prove the nature of the
soil, wherever considered necessary by the competent authority.
Such test must be made for all sites intended to be constructed
upon with buildings having more than 3 storeys.

c. Where a building is to be erected near a drain or an excavation at a


distance of less than the depth of the said drain or excavation the
owner shall satisfy the administration that the foundations of the
building are safe.

d. The owner shall submit structural calculations or a certificate from


a qualified structure engineer to verify the foundations and super
structure, if required by the competent authority.

e. Proper damp-proofing shall be provided for walls and floors


according to the standard specifications.

f. Where the floor or wall of a building is, in the opinion of the


competent authority, subject to water pressure that portion of the
building below ground level shall be suitably water-proofed.

iii. Stair Cases and Lifts


a. All residential buildings shall have stair cases having a minimum
clear width of 3 feet.
b. In commercial buildings stair cases shall have the following
minimum width for all storeys:
Upto 3 storeys - 3 feet and 6 inches
Above 3 storeys - 4 feet
c. The riser of stair case steps shall not be more than 8 inches and the
tread not less than 10 inches.
d. A landing shall not be less than 3 feet in depth.
e. All stair cases in multi-storied buildings shall be of re-inforced
cement concrete or other non-inflammable material.
f. Lift shall be essential if the building has more than 3 floors above
the ground floor.
21. Fire Resistance and Fire Precautions

i. A building or any structural part of a building shall be deemed to have an


adequate standard of fire resistance.
ii. Every garage shall be constructed of fire resisting materials of good
standard.
22. Miscellaneous
i. No street shall be closed which is existing at site.
ii. Sanction shall be required from Tehsil Municipal Administration Chakwal
for the construction of boundary wall around the open plot after paying
prescribed fee.
iii. In all the cases where the building is already in existence (old
construction) regulation charges shall be equivalent to prevalent building
fee for the purpose of sanction by Tehsil Municipal Administration
Chakwal if it does not violate the space standards formulated under these
bye-laws.
iv. PT-I Form / PTD Form as title documents shall be acceptable for the city
area i.e. within circular road incurring old Abadi, if any subject to the
verification by the Naib Union Nazim of the said area. Moreover, it shall
be advertised in the newspaper for information or objections of the general
public.

v. Building plan shall be admitted only if it is in accordance with the


prevailing building Bye-laws and subject to the verification of site by the
building inspector concerned.
vi. NAZIM, Tehsil Municipal Administration Chakwal may relax any
provision of these Bye-laws, but after recording solid reasons.
vii. These Bye-laws shall extend to the whole of the Tehsil Chakwal, but
kacha buildings shall be exempted subject to the condition that no
encroachment is being made upon any public / private land.
viii. Any policy / direction pertaining to these Bye-laws, issued from time to
time, by the Government shall be considered part of these Bye-laws.
