INFORMATION REGARDING THE PROCESSING OF PERSONAL DATA
Pursuant to Regulation (EU) 679/2016 regarding the protection of personal data, Maui Jim Italy Srl informs clients that any personal data (personal, identifying and/or tax details) obtained from them due to and in connection with the Contract will be subject to processing within the terms indicated below: - the above data may be subject to processing carried out using paper documents and archives as well as through the use of electronic, computerised, telematic or, in any case, automated means; - the processing of the above-mentioned data consists of collection, registration, storage and processing operations. Data processing is carried out: (i) to execute the services envisaged by the Contract as well as to fulfil any subsequent legal, administrative, accounting or tax obligations. Providing the aforementioned data is optional but essential in order to execute the Contract; any refusal to provide this data will, therefore, make executing the Contract impossible; (ii) to send commercial information, specifically to the email address indicated by the client, relative to Maui Jim Italy Srl services and products as well as to allow the same to carry out market research. Providing the aforementioned data is optional and refusing to provide it will have no effect on the execution of the Contract. No personal data will be disclosed to any third party. Personal data may be communicated and transferred, within the scope of the purposes mentioned above, to those companies which are part of the same group as Maui Jim Italy Srl (parent companies, subsidiary companies, associated companies, investing companies and companies invested in) in Italy, in other countries of the European Union or in a third country, in compliance with the provisions referred to in articles 45 et seq. of Regulation (EU) 679/2016. Without prejudice to communications made in order to comply with legal provisions, regulations or EU legislation, personal data will be processed by the Controller’s employees and contractors in relation to their specific work duties, and may be communicated to companies, suppliers and professionals who provide products and services (for example within the scope of accounting, tax, legal or technical issues) or, in any case, to parties who need to access the personal data in order to carry out the services requested of them. In any case, only that personal data which is strictly necessary to the purpose for which it was collected will be transferred. It should also be noted that the nature of the services normally provided does not typically involve the processing of so-called “particular categories of data” (such as, purely by way of example, personal data that can be used to reveal someone’s racial or ethnic origin, their religious convictions, political beliefs, their state of health or details about their sex life, etc.). However, if Maui Jim Italy Srl’s knowledge of this data were to be implicitly deduced from the type of service or product requested (for example, documentation regarding graduated lenses which could reveal the client’s state of health), consent from the client for the purposes referred to in point (i), above, would also regard the processing of this data. If, though, knowledge of the so-called “particular categories of data” is necessary in order to provide the specific Maui Jim services and/or products requested, we will request the client’s consent as and when necessary. By means of a written request sent to the Controller, a data subject may (i) obtain access to the personal data which concerns him/her in order to learn the source of such data, the purpose(s) for which this data is processed, the logic applied when processing such data by electronic means, the categories of data held, the recipients (or categories of recipient) to whom such data may be communicated, the storage period for such data, and the communication of such data in an intelligible form; (ii) have such data rectified, supplemented, erased and to have processing of the same restricted, (iii) object to the processing of personal data, (iv) request that the data be made portable, where relevant; (v) revoke consent at any moment, (vi) lodge a complaint with a Supervisory Body. The data subject, A) With regard to the processing of his/her personal data for the purposes referred to in point (i), above, of this information notice, declaring to have been made aware that some data might fall into the category of so-called “particular categories of data” and to have also been made aware of the fact that this data could be transferred to companies which are in the same group as Maui Jim Italy Srl, that is parent companies, subsidiary companies, associated companies, investing companies and companies invested in, in Italy, in other countries of the European Union or in a third country as well as communicated to companies, suppliers or professionals in order to comply with legal provisions, regulations or EU legislation.
