AND CONSENT TO PUBLISH

depose and state that:

1. I submitted my entry material for the “Newsletter Naming Contest”

2. My entry “_______________________” is my original work and/or design and the same does
not violate and/or infringe any intellectual property rights, trademark, trade name, patent
and/or copyright of any third party, author or designer. A copy of my said entry is hereto
attached and made an integral part hereof as Annex “A”;

3. My aforesaid entry was not published, submitted to or is under consideration of any other
publication, entity or third party;

4. Upon submission of my aforesaid entry to ___________, my ownership and rights to the said
entry is transferred to _________ and the latter shall have exclusive right or ownership to the
same including the unlimited right to use and/or publish my entry. It is understood that in the
event that ___________ will choose my entry as the name of the soon to be Newsletter of
___________, I will not be entitled to any other compensation aside from the price given by
__________ to the winning entry of the above-mentioned Newsletter Naming Contest;

5. If my entry should later be found to have violated any intellectual property rights, trademark,
tradename, patent or copyright of any third party, I shall be solely liable for the same and I
shall defend, indemnify and hold harmless __________ against any and all claims for
infringement, losses, suits and damages from any third party/ies for my entry including, but
not limited to, court judgements, settlements, attorney’s fees and costs of suit; and

6. I am executing this Affidavit freely and voluntarily and I am fully aware and I have fully
understood of the contents hereof and the consequences of this Affidavit.
